13.72.010 Discharging firearms and using slingshots or blowguns prohibited--Exceptions.

It is unlawful for any person to fire or discharge, or cause to be fired or discharged, any firearm or gun of any nature, or make use of any slingshot or blowgun within the City limits except as provided in this chapter. (Ord. 2878-NS § 1, 1947)

13.72.020 Firearms--Use permitted when.

The provisions of Section 13.72.010 shall not apply in the following cases:

A.    To sheriffs, constables, marshals, policemen or other duly appointed peace officers in the discharge of their official duties, nor to any person summoned by any such officer to assist in making arrests or preserving the peace while said person so summoned is actually engaged in assisting such officer;

B.    To members of the Army, Navy or Marine Corps of the United States, or the National Guard when on duty, nor to any other organizations which, by the United States federal government, are authorized to use such firearms;

C.    To members of any lawfully organized club when using said firearms for the purpose of practicing shooting at targets upon police-approved target ranges;

D.    To persons using firearms in necessary self-defense and in a careful manner;

E.    To persons using firearms for the purpose of destroying noxious animals upon land owned or occupied by them;

F.    To the owner or occupant of any land who has been granted temporary permission by the Chief of Police to shoot birds, otherwise lawfully killed, when they become a nuisance on such land;

G.    To persons shooting ducks or other game birds in San Francisco Bay, provided that said shooting shall not be done within one thousand feet of the shoreline or within one thousand feet of any pier, bulkhead or similar structure;

H.    To persons firing blank cartridges in shows, athletic contests or other public performances. (Ord. 2878-NS § 2, 1947)

13.72.030 Shooting range--Conducting for profit prohibited.

It is unlawful to do any shooting for profit, or to conduct any shooting gallery or range for profit within the City limits. (Ord. 2878-NS § 3, 1947)

13.72.040 Shooting range--Permit--Issuance authorized when.

Persons or organizations may be issued a permit by the Chief of Police to establish and maintain a shooting range indoors at which shooting without profit may be done with rifles of .22 mm fire caliber, pistols and revolvers. (Ord. 2878-NS § 4, 1947)

13.72.050 Shooting range--Permit--Issuance prohibited.

The Chief of Police shall not issue a permit to any person under the age of twenty-one years, or to any person who is not a citizen of the United States or to any person who has ever been convicted of a felony, or to any person who is a member of any group or organization whose principles, ideals and practices are not in keeping with the best interests of the United States of America or any political subdivision thereof. 13.72.060 Shooting range--Permit--Period of validity--Not transferable.

Permits issued by the Chief of Police shall be valid for a period of one year from the date of issuance and shall not be transferable from one person to another or from one location to another, and there shall be no charge for such permit. (Ord. 2878-NS § 5, 1947)

13.72.070 Shooting range--Permit--Posting requirements.

The shooting range permit issued by the Chief of Police shall be posted in a conspicuous place near the firing point at all times. (Ord. 2878-NS § 7, 1947)

13.72.080 Shooting range--Permit--Revocation authorized when.

A permit issued under the provisions of this chapter may be revoked by the Chief of Police for any violation of any provision of this chapter, or for any of the reasons for which a permit may be denied as provided in Section 13.72.050. (Ord. 2878-NS § 12, 1947)

13.72.090 Shooting range--Regulations generally--Inspection requirements.

All shooting ranges shall be designed, constructed and maintained in a safe condition with regard to the health, peace and safety of persons and property and in accordance with the regulations and specifications adopted by the Chief of Police, and all shooting ranges must be open to inspection by police officers at all reasonable times. 13.72.100 Shooting range--Use by certain persons prohibited.

No shooting shall be done on such range by any person not a citizen of the United States of America, or any person who has ever been convicted of a felony, or any person who is a member of any group or organization whose principles, ideals and practices are not in keeping with the best interests of the United States of America or any political subdivision thereof. (Ord. 2878-NS § 10, 1947)

13.72.110 Shooting range--Use by minors prohibited.

No shooting shall be done on any such range by any minor unless directly supervised by an adult who possesses qualifications such as would allow his being issued a permit for a shooting range. (Ord. 2878-NS § 11, 1947)

13.72.120 Shooting range--City liability limitations.

The issuance of such permit shall not be an assumption of responsibility on the part of the City or any employee thereof for civil damages which may accrue from accidents to persons or property arising from the use, legal or illegal, of such range. (Ord- 2878-NS § 8, 1947)

13.72.130 Violation--Penalty.

Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable as set forth in Chapter 1.20 of this code. (Ord. 2878-NS § 13, 1947)
