8.12.010 Open fires prohibited.
It is unlawful for any person to conduct an open fire that creates a public or private nuisance or is a hazard to public safety. [Ord. 440-2006 § 1].
8.12.020 Exceptions.
Outdoor fires for pleasure, religious, ceremonial or cooking purposes contained within fireplaces, barbecue grills or pits, or other enclosures designed for outdoor recreation or cooking, are permitted. [Ord. 440-2006 § 2].
8.12.030 Permission required.
A person must obtain permission from the city fire chief before any outdoor burning. All persons must comply with rules adopted by the State Fire Marshal, Oregon Department of Environmental Quality, city council resolution and administrative rules adopted by the city fire chief. [Ord. 440-2006 § 3].
8.12.040 Reimbursement of city costs.
Any person who conducts an open fire in violation of any state or city burning rule, including rules adopted by the city fire chief, must reimburse the city for all costs associated with a fire department response to that fire in accordance with the most recent reimbursement cost schedule adopted by the city fire chief. [Ord. 440-2006 § 4].
8.12.050 Violation – Penalty.
A. A first time violation of this chapter is punishable by a fine of up to $50.00.
B. A second violation of this chapter is punishable by a fine of up to $100.00.
C. A third or more violation of this chapter is punishable by a fine of up to $500.00.
D. In addition to any fine, any burning permission may be revoked for a violation. For a second and further violation, a new burning permission may not be granted for up to one year from the last violation and the offender must attend a safe burning class sponsored by the city. [Ord. 440-2006 § 5].
