1.25.010 Penalty.

A. Any person who shall violate any provision of this code, unless otherwise specifically specified, shall be guilty of a Class B misdemeanor and shall for any one offense be punished by a fine of not more than $1,000 or by imprisonment not to exceed six months or by both such fine and imprisonment.

B. Any corporation, association, partnership or governmental instrumentality which shall violate any provision of this code shall be guilty of a Class B misdemeanor and for any one offense shall be punished by a fine of not more than $5,000. [Code 2000 § 1-3-1].

1.25.020 Liability of employers and agents.

When the provision of an ordinance prohibits the commission or omission of an act not only the person actually doing the prohibited thing or omitting the direct act, but also the employer and all other persons aiding or abetting therein, shall be guilty of the offense described and liable to the penalty prescribed for the offense. [Code 2000 § 1-3-2].

1.25.030 Liability of officers.

No provision of this code designating the duties of any officer or employee shall be so construed as to make such officer or employee liable for any fine or penalty provided for a failure to perform such duty, unless the intention of the city council to impose such fine or penalty on such officer or employee is specifically and clearly expressed in the section creating the duty.
