10.05.010 Traffic code adopted.

A. The provisions of Title 41, entitled, “Motor Vehicles,” as set forth in the Utah Criminal and Traffic Code, 1992 Edition, and subsequent editions, as compiled, prepared and published in book form by the Utah Department of Public Safety, are hereby approved and adopted as the traffic code for West Point City.

B. Whenever the context so indicates or requires, the name of West Point City or any of its agencies or offices shall be used in place of any state agencies or offices used in the said Utah Criminal and Traffic Code, 1992 Edition, to the extent necessary to implement the intent of adopting the traffic code as referred to herein. 10.05.020 Citation to code.

Where a citation or complaint is issued, it shall be sufficient to use the number of the Utah Code followed by “West Point City Code,” to show the section of the ordinance of the city which has been violated. [Code 2000 § 6-2-2].

10.05.030 Prima facie speed – Posted streets.

A. When appropriate traffic control or regulatory signs giving notice of speeds are posted, the prima facie maximum speed limits designated upon said signs shall apply to the appropriate streets or portions of streets so posted.

B. In the absence of any speed limit sign in an urban district designating a speed limit applicable thereto, the prima facie speed limit shall be 25 miles per hour. [Code 2000 § 6-2-3].

10.05.040 Traffic control.

The traffic control and regulation of all public streets shall be as posted, regulated or controlled by appropriate traffic control devices, signs or other regulatory devices or controls. The city engineer shall place and maintain all traffic control devices when and as required under the ordinances of this city to make effective the provisions of said ordinances, and may place and maintain such additional traffic control devices as he may deem necessary to regulate, guide or warn traffic under the traffic ordinances of this city. 10.05.050 Unlawful parking.

A. Parking at Curb. No motor vehicle shall be parked with the left side of the vehicle next to the curb, except on one-way streets. It shall be unlawful to stand or park any motor vehicle in a street other than parallel with the curb and with the two right wheels of the vehicle within 12 inches of the regularly established curb line except on those streets which have been marked for angle parking; then vehicles shall be parked at the angle to the curb indicated by such marks.

B. Vehicles for Sale. It shall be unlawful to park any vehicle on any street for the purpose of displaying it for sale.

C. Loading Zone. When so posted, it shall be unlawful for the driver of a passenger vehicle to stand or park such vehicle for a period of time longer than is permitted by the posted sign for the loading or unloading of passengers, or for the driver to stand or park any freight-carrying motor vehicle for a period of time longer than is necessary to load, unload and deliver materials in any place designated as a loading zone and marked as such.

D. Parking Prohibited. It shall be unlawful for any person, except physicians on emergency calls or designated emergency vehicles when properly posted, to park any motor vehicle or trailer on any street in violation of the posted restrictions. It shall be unlawful to park any vehicle or otherwise cause any obstruction to any fire station or other place where fire apparatus is stored, or within five feet of any fire hydrant or cistern.

E. Alleys. No person shall park a motor vehicle within an alley in such manner or under such conditions as to leave less than 10 feet of the width of the roadway available for the free movement of vehicular traffic. No person shall stop, stand, or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property.

F. Cab Stands – Bus Stands. No motor vehicle other than a licensed taxicab shall be parked in any area designated by ordinance as a taxicab stand and no vehicle other than a bus shall be parked in a place so designated as a bus loading zone.

G. Parking over 48 Hours. It shall be an infraction for any person to park or leave standing on any public road, street, alley or municipal property any vehicle or trailer for 48 or more consecutive hours, and any vehicle so parked or left standing may be impounded or removed by law enforcement officials. For purposes of impoundment and removal, law enforcement officials may, after making a reasonable effort to locate the owner, impound and remove any motor vehicle which has been unmoved for 48 consecutive hours. The cost of impoundment and removal shall be charged to the owner or any person who claims the impounded motor vehicle.

H. All-Night Parking Prohibited.

1. No person shall park a vehicle on any street for any period of time between the hours of 1:00 a.m. and 6:00 a.m. of any day, except physicians during emergency calls and other emergency personnel/city vehicles.

2. No person who owns or has possession, custody or control of any vehicle shall park said vehicle upon any street or alley for more than a consecutive period of 21 hours except as provided in subsection (H)(1) of this section.

3. The provisions of subsections (H)(1) and (2) of this section shall be enforced within the limits of this city commencing the first day of November of each year and up to and including the last day of February of the following year, and shall not be enforced from the first day of March up to and including the thirty-first day of October of each year; provided, however, that subsections (H)(1) and (2) of this section shall be enforced continuously throughout all months of the year as to horse trailers, house trailers, junk cars, vehicles or trucks larger in size than three-quarter-ton pickups, or other vehicles of like character.

I. Parking of Commercial Vehicles – Residential Zone. No trucks, motor vehicles or commercial trailers or construction equipment which exceed the rated capacity of one and one-half tons shall be stored or parked within the required front yard on any lot in any residential zone, or on any street.

J. Parking Contiguous to Schools. No person shall stop a motor vehicle on the opposite side of the public road running adjacent to any school within West Point City at any time one-half hour before school starts or one-half hour after school ends for the purpose of dropping off or picking up a passenger or passengers.

K. Parking Not to Obstruct Traffic. No person shall park any vehicle upon a street in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for free movement of vehicular traffic.

L. Boats and Trailers. Boats, boat trailers, or travel trailers may not be placed, kept, or maintained within the front yard areas of any residential (R-) zones, except that such boats or trailers may be located anywhere on the lot except in a clear vision zone of a corner lot for a temporary period not to exceed 24 hours for loading and unloading purposes, or for temporary storage not to exceed seven days if such facility is owned by a bona fide guest of the occupants of the premises. 10.05.060 Markings to indicate no stopping and parking regulations.

A. The city engineer is hereby authorized, subject to provisions and limitations of this code and after a comprehensive study, to place and maintain appropriate signs or traffic markings to indicate standing or parking regulations, and said traffic markings shall designate the zones and shall have the meanings herein set forth:

1. Red shall mean no stopping, standing, or parking at any time.

2. Yellow, with the words “Restricted Zone” stenciled thereon, shall mean no stopping, standing, or parking except as stated on the signs or markings giving notice thereof, except that this provision shall not apply on Sundays and legal holidays.

B. When appropriate signs or traffic curb markings have been erected or placed according to this section, no person shall stop, stand, or park a vehicle in any zone in violation of any of the provisions of this section. [Code 2000 § 6-2-6].

10.05.070 Negligently colliding.

It shall be unlawful to operate a vehicle with such lack of due care and in such negligent manner as to cause the same to collide with any vehicle, person or object. [Code 2000 § 6-2-7].

10.05.080 Duty to keep proper lookout.

No person shall drive a vehicle on the streets of this city without keeping a reasonable and proper lookout for other traffic, people, objects, fixtures or property thereon or adjacent thereto. [Code 2000 § 6-2-8].

10.05.090 Stop and yield intersections.

When appropriate, traffic control or regulatory signs are posted at intersections identifying them as stop or yield entrances and such streets are hereby declared to be stop or yield entrances. [Code 2000 § 6-2-9].

10.05.100 Parking or blocking streets or highways.

In addition to the parking provisions contained in the Utah Traffic Code, as adopted by this municipality, it shall be unlawful for any person to:

A. Remain standing, lying or sitting on any street or highway in such a manner as to obstruct the free passage of vehicular or pedestrian traffic thereon.

B. Willfully remain standing, lying or sitting on any street or highway in such manner for more than one minute after being requested to move by any police officer.

C. Willfully remain on such street or highway in such manner as to obstruct the free passage of any person or vehicle into or out of any property having access to such street or highway. [Code 2000 § 6-2-10].

10.05.110 Use of dynamic braking devices prohibited.

A. A “dynamic braking device” (commonly referred to as a jacobs brake, engine brake, or compression brake) means a device used primarily on trucks for the conversion of the engine from an internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes.

B. It is unlawful for any person to operate any motor vehicle with a dynamic braking device engaged, except for the aversion of imminent danger, within the West Point City limits. Fire trucks and other emergency vehicles shall be exempt from the prohibitions of this section. [Code 2000 § 6-2-11].
