13.35.010 Connection required.
The record owners, or their duly authorized agents, of all residential sites where pressure irrigation is available shall connect their properties to a pressure irrigation system and pay the applicable fees and charges. [Code 2000 § 9-6-1].
13.35.020 Subscriber only to use water.
It shall be unlawful for the owner or occupant of any property served by a pressure irrigation system, or any user thereof, to permit any person from other premises, or any unauthorized persons, to use or obtain water regularly from his premises or pressure irrigation fixtures. [Code 2000 § 9-6-2].
13.35.030 Pipes to be kept in good repair.
All pressure irrigation users shall keep their service pipe and connections and other apparatus in good repair and protected from frost at their own expense, but no person, except under the direction of the public works superintendent, shall be allowed to dig into the street, sidewalk or other public property or right-of-way for the purpose of laying, removing, or repairing any service pipe. 13.35.040 Waste of water prohibited.
It shall be unlawful for any pressure irrigation user to waste water, or to allow it to be wasted, or wastefully to run water from faucets or stops or through basins, or other apparatus, or to use the water in such a manner as to cause it to overflow into the neighboring yards, property, or streets. 13.35.050 Connection authority.
It shall be unlawful for any person to connect or cause to be connected a service line to any pressure irrigation system without authority of the owner of the system. [Code 2000 § 9-6-5].
13.35.060 Water use.
It shall be unlawful for any person to use or cause to be used any water from a pressure irrigation system for other than irrigation purposes. [Code 2000 § 9-6-6].
13.35.070 Destruction of or interference with system.
It shall be unlawful for any person to destroy, deface, injure or interfere with the operation of any part, pipe, fixture, appliance or appurtenance of any pressure irrigation system. [Code 2000 § 9-6-7].
13.35.080 Introducing substances.
It shall be unlawful for any person to place, cause to be placed or to introduce into any pressure irrigation system or any source of water supplying said systems any matter, substance, chemical or compound without authorization from the owner of such systems. [Code 2000 § 9-6-8].
13.35.090 Water shortage.
The city council may, by resolution, regulate, restrict or limit the use of water during water shortage periods and shall have the power to take all necessary means and make any necessary regulations as circumstances may require to protect the users of pressure irrigation. [Code 2000 § 9-6-9].
13.35.100 Rate schedules.
Rate schedules deemed necessary or expedient shall be adopted by the city council by resolution without publication thereof and all such schedules and charges shall be effective as specified in the resolution. [Code 2000 § 9-6-10].
13.35.110 Failure to pay for service – Termination.
In case the owner of any of the premises served by pressure irrigation, or the tenant or occupant, shall fail to pay the required fees and charges applicable to the pressure irrigation system or violates any provisions of this chapter, the city may cause the utilities, including but not limited to culinary water, pressure irrigation water and sewer service, to be shut off from such premises, and the city shall not be required to turn the same on again until all arrears shall be paid in full. 13.35.120 Turning on pressure irrigation without authority.
It shall be unlawful for any person, after the pressure irrigation has been turned off from his premises for either nonpayment of charges as provided for herein or for a violation of the rules and regulations pertaining to the pressure irrigation systems, to turn on or allow the water to be turned on or used without authorization from the owner of the pressure irrigation system. 13.35.130 Interconnections prohibited.
It shall be unlawful for any person to:
A. Interconnect or cause to be interconnected a pressure irrigation system and the West Point City water system or service lines or extensions of said systems.
B. Extend or cause to be extended into any building a pressure irrigation system or service line.
C. Expose or cause to be exposed any portions of a pressure irrigation system or extensions or service lines thereof without identifying the same by suitable means sufficient to distinguish it from culinary water systems, extensions, or service lines. [Code 2000 § 9-6-13].
