5.40.010 Definitions.
As used in this title:
“Abstract of title” means a condensed history of the title to land together with a statement of all liens, charges or liabilities to which the land may be subject.
“Appraisal” means an estimate of value of property by a person licensed by the state of Alaska as a general appraiser for the appraisal of commercial properties and/or a residential appraiser for the appraisal of residential properties.
“Casual use” means the temporary, safe, non-exclusive and non-surface-disturbing use of city land and includes but is not limited to such uses as: hiking, skiing, fishing, picnicking and berry picking.
“City boundaries” means the city limits, inside which all city ordinances are enforceable.
“Contract of sale” means a contract between a willing seller and a willing buyer to transfer title to property.
“Deed of trust” means an instrument, taking the place and serving the use of a mortgage, by which the legal title to real property is placed in a trustee, to secure the repayment of a sum of money or the performance of other conditions.
“Disposal” means the act of giving away or selling; the transfer of interest in property.
“Easement” means a right or privilege in another’s land, such as the right to cross for a specific purpose. This does not grant ownership.
“Economic development” means to promote the growth of the local economy; increase income of residents.
“Eminent domain” means the power of a city to take private property for a public use.
“Equitable interest” means a claim (in a property or other) which should be recognized in the interest of fairness or equity.
“Federal entity” means the federal government or its agency.
“Interest” means in property a right, claim, title or legal share in that property. Methods of transfer include deed, lease or easement.
“Lease” means to dispose of specific interests in real property without transferring ownership of that property; a contract for exclusive possession of lands or tenements for a set period.
“Legal description” means that part of a conveyance document that identifies the land or premises intended to be affected.
“Non-code ordinance” means an ordinance that is not part of the permanent city code.
“Nonprofit corporation” means an organization formed under the laws of the state of Alaska not to obtain a profit, but to supply an essential service to its constituents.
“Public interest” means something in which the public, the community at large, has some pecuniary interest (having to do with money), or some interest by which their legal rights or liabilities are affected.
“Public outcry auction” means the sale of property to the highest bidder, at a public auction, where each prospective buyer has the right to enter successive bids until a price has been reached at which no higher subsequent bid is made.
“Public service” means activities and enterprises that specially serve the needs of the general public.
“Real property” means any estate in land, easement, right-of-way, lease, permit, license, franchise, future interest, building, fixture, or any other right, title or interest in land or a building.
“Revert” means return of title to the former owner.
“Sealed bid” means a written offer to purchase property, placed in an envelope, and opened along with all other bids (if any) at a public bid opening.
“State” means the state of Alaska or any state of Alaska agency.
“Substantial improvement” means a major change or addition to land or real property that makes it more valuable.
“Temporary uses” means an exclusive use of city land that has a duration of one year or less, involves minimal disturbance to the land, and does not allow permanent structures or improvements. (Ord. 94-16 (part), 1995.)
