13.08.010 Authority.
A. This title shall be administered and enforced by the city manager. The city council shall have the authority to establish and regulate monthly utility rates for sewerage services and connection fees for all users, but no person shall be bound by any such rate unless it shall have been posted for public inspection for five consecutive days after its adoption at the City Hall.
B. The city manager shall appoint a superintendent to enforce the regulations contained in this title. (Ord. 88-05, 1988.)
13.08.020 Inspection authority.
A. The city, through its designated representative or representatives, is authorized to enter all properties for the purposes of inspection, observation, measurement, sampling, and testing to determine satisfactory compliance with the title and regulations promulgated hereunder.
B. While performing the necessary work on private properties referred to in this section, the superintendent or duly authorized employees of the city shall observe all safety rules applicable to the premises established by the building sewer user (the company), and the company shall be held harmless for injury or death to the city employees, and the city shall indemnify the company against loss or damage to its property by city employees and against liability claims and demands for personal injury or property damage asserted against the company and growing out of the gauging and sampling operation, except as such may be caused by negligence or failure of the company to maintain safe conditions as required by appropriate state, local, and federal regulations, laws, and ordinances.
C. The superintendent and other duly authorized employees or the city shall be permitted to enter all private properties through which the city holds a duly negotiated easement for the purposes of, but not limited to, inspection, observation, measurement, sampling, repair, and maintenance of any portion of the sewerage system lying within said easement. All entry and subsequent work, if any, on said easement shall be done in full accordance with the terms of the duly negotiated easement pertaining to the private property involved. 13.08.030 Additional regulations.
The city council shall from time to time adopt such additional regulations, provisions, and procedures pertaining to sewerage system services as it deems proper. (Ord. 88-05, 1988).
13.08.040 Operation.
The sewerage system shall be operated and maintained by an operator or operators certified as required by the State of Alaska. (Ord. 88-05, 1988.)
