13.16.010 Disconnection for misuse.

A.    Independent of any prosecution for violations of any provision of this title, the city may discontinue sewer service where defective fixtures or misuse of water and sewerage facilities may affect the safe and proper operation of the city sewerage system, where there is a refusal to permit an inspection by the city, or when the customer’s payments are more than sixty days delinquent.

B.    Where the user is served by the water system, disconnection shall be by shutoff of water service to the property.

C.    Where the user is not served by the water system, disconnection may be made by excavating and exposing the building sewer within the right-of-way or easement and capping the pipe.

D.    In order for service to be reinstated, the user shall pay, in advance, for the full cost of delinquent charges, plus all charges associated with the disconnection and reconnection operations. (Ord. 88-05, 1988.)

13.16.020 Penalties.

A.    Any person violating any of the provisions of this title shall become liable to the city for any expense, loss, or damage occasioned the city by reason of such violation.

B.    Any person found to be violating any provision of this title shall be served by the city with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.

C.    Any person who willfully continues any violation beyond the time limit provided for in the written notice is guilty of an infraction and, upon conviction thereof, shall be fined in an amount not exceeding three hundred dollars for each violation and must also pay any surcharge required to be imposed under AS 12.55.039. Each day in which any such violation continues shall be deemed a separate offense. In addition to law enforcement officers, the city public works department is authorized to issue citations for any violation of this title.

D.    The city attorney may obtain a civil injunction or temporary restraining order to obtain immediate compliance with any provision of this chapter. In addition to any penalties assessed, the city may petition the court for award of reasonable attorneys’ fees and costs of prosecuting such an action.
