13.24.010 Sale of timber.

A. The Mayor shall provide for cruises of timber lands and transmit this data to the City Council, together with his recommendations with respect to:

1. The timber which should be offered for sale; and

2. The terms of sale of the timber.

B. The City Council, upon recommendation of the Planning Commission and the Mayor, shall by resolution determine the timber to be sold, and the limitations, conditions and terms of sale. The limitations, conditions and terms shall include the utilization, development and maintenance of the sustained yield principle, subject to preference among other beneficial users. The Mayor may negotiate sales of timber without advertisement and on the limitations, conditions, and terms which he considers are in the best interest of the City, subject to the approval of the City Council with the advice of the Planning Commission. However, the amount of timber sold by such nonadvertised negotiated sales within a one-year period to any individual, group or corporation, acting either jointly or severally, shall not exceed 500,000 board feet in quantity or $7,500 in total value. 13.24.020 Procedure for disposal of timber.

Timber sales of more than 500,000 board feet in quantity or $7,500 in total value shall be by sealed bid or public auction, depending on which method is determined by the City Council to be in the best interest of the City, to the highest qualified bidder as determined by the Council. The sale shall be conducted by the Mayor or his representative, and at the time of sale the successful bidder shall deposit the amount specified in the terms of sale. The means by which the amount of deposit is determined shall be prescribed by appropriate regulations. The Mayor or his representative shall immediately issue a receipt containing a description of the timber purchased, the bid price and the terms of sale. The receipt shall be acknowledged in writing by the bidder. A contract of sale, on a form approved by the City Attorney, shall be signed by the purchaser and by resolution of the Council, the contract shall be signed by the Mayor on behalf of the City. The Mayor, with the approval of the City Council, may impose conditions, limitations and terms considered necessary and proper to protect the interests of the City. Violation of any provisions of the contract shall be grounds for termination of the contract by the City Council. (Ord. 78-N-1, 1978; Ord. 97-06, 1997)

13.24.030 Marking of timber.

All the timber to be removed under contract shall be hammer-marked by the contractor with a tool issued by the City capable of embossing a contract code number. Only timber from a contract cut area shall be marked with the applicable tool. The tool shall be returned or confiscated following the termination of the contract. (Ord. 78-N-1, 1978)

13.24.040 Disposal of gravel, peat and other materials.

It shall be the policy of the City to make available gravel, peat or other materials which the City may have available for City development which does not conflict with private enterprise, and/or for purposes of local development. All sales shall be for not less than current prevailing prices and shall provide, as far as possible, for the protection of the environment. Regulations governing such sales shall be established by City Council resolution. (Ord. 78-N-1, 1978)
