Chapter 12.10
VIOLATIONS AND PENALTIES
Sections:
12.10.010 General penalty.
Any person who violates any provision of this title, or performs any unlawful act as defined in this title, or fails to perform any act required by this title, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed $500.00 or imprisonment for not more than 30 days, or both such fine and imprisonment. Each day of violation is a separate offense and is punishable accordingly as provided herein. (Ord. 930 § 2, 1980)
12.10.015 Public nuisances.
The city council finds, determines and declares that the public health, safety and welfare, and the protection of the inhabitants of the city, requires the adoption and promulgation of the provisions, restrictions and requirements set forth in this title and requires the control of the time, place and manner of the construction, maintenance, operation, and discharge into sewer pipelines, pump stations, treatment plants, works and other sewer facilities and appurtenances and the charges therefor as set forth in this title, and further finds, determines and declares that violation of, or failure to comply with, any of the provisions of this title constitutes a public nuisance and in addition to any other remedy otherwise provided by law may be enjoined. 12.10.020 Fine schedule.
Pursuant to KMC 1.02.110 the following fine schedule is established for violations of this title and of the codes and regulations as adopted by this title:

The fine schedule for a second offense of the same section within 12 months shall be twice the amount listed above. The fine schedule for a third and subsequent offense of the same section within 12 months shall be triple the amount listed above. (Ord. 1269 § 11, 1993)
