4.50.010 ESTABLISHMENT.

There is established an emergency planning board.

4.50.020 FUNCTION.

(A)    The emergency planning board shall:

(1)    serve as the local emergency planning committee (LEPC) under the Superfund Amendments and Reauthorization Act of 1986, Title 42 U.S.C. §§ 11.001 et seq.;

(2)    serve as the coordinating agency for emergency planning within the borough;

(3)    conduct an annual hazards assessment of the borough;

(4)    coordinate requests and information under the federal and state community right-to-know regulations;

(5)    coordinate the board’s activities with other boards to facilitate the safety of the borough;

(6)    review and make recommendations to the assembly on hazardous materials, transportation routes and locations;

(7)    annually review and update the borough disaster plan;

(8)    assist local, borough, state, and federal agencies with disaster exercises;

(9)    coordinate the borough’s disaster planning with those of other local governments; and

(10)    coordinate the borough’s disaster planning with those of local industry and utilities.

4.50.030 COMPOSITION.

(A)    As is feasible, the emergency planning board shall be composed of 33 members representing the following:

(1)    borough emergency services administration;

(2)    borough government;

(3)    city of Houston, non-law enforcement;

(4)    city of Palmer, non-law enforcement;

(5)    city of Wasilla, non-law enforcement;

(6)    emergency medical services;

(7)    fire service;

(8)    hospital;

(9)    news media, news relations, public information officer, or public relations;

(10)    public utilities:

(a)    telecommunications;

(b)    gas; and

(c)    electric;

(11)    school district;

(12)    Alaska Railroad Corporation;

(13)    civil defense;

(14)    trucking or transportation;

(15)    law enforcement:

(a)    Alaska State Troopers;

(b)    Wasilla police;

(c)    Palmer police; and

(d)    Houston police;

(16)    no more than a total of ten members drawn from one or more of the following areas:

(a)    environmental groups;

(b)    business and development interests; or

(c)    other specific technical expertise as deemed necessary;

(17)    Tribal government;

(18)    public health agency; and

(19)    elected official.

(B)    When a representative seat vacancy is best served by appointment of a nominee employed within the borough, but residing elsewhere, residency requirements may be waived.

4.50.035 COMPENSATION.

Commission members shall be reimbursed for mileage incurred in connection with meetings of the board in the same manner as borough employees are compensated for mileage expenses upon presentation of supporting documentation satisfactory to the appropriate director.

4.50.040 ORGANIZATION.

(A)    The emergency planning board shall have one chairperson and one vice chairperson. The term of the elected officers shall be two years.

(B)    The emergency planning board may have subcommittees as necessary to carry out the duties of the board.

4.50.050 QUORUM.

Ten authorized board members shall constitute a quorum for the purposes of transacting business.

4.50.055 TERM OF MEMBERS.

(A)    Irrespective of the limits specified in MSB 4.05.050, a member may serve more than two consecutive terms.
