CHAPTER 18.01: GENERAL PROVISIONS

18.01.005 DEFINITIONS.
(A) For the purpose of this title, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
(1) "Beneficial industrial” or "commercial enterprise” means an enterprise as defined in MSB 23.05.150.
(2) "Ground lease” means a lease of borough lands by the manager, with the concurrence of the port commission.
(3) "Immediate family” includes parents, spouse, children, grandparents, grandchildren, brothers, sisters, aunts, uncles, nephews, nieces, and/or any other relatives residing permanently in the same household.
(4) "Master plan” means that plan which designates areas of port district land for specific purposes, including but not limited to roads, staging areas, cargo storage areas, utility corridors, foreign trade zones, industrial areas, commercial areas and docks.
(5) "Planning commission” means the Matanuska-Susitna Borough Planning Commission, established by MSB title 15.
(6) "Port administration” means the port director and port staff.
(7) "Port commission” means the Matanuska-Susitna Borough Port Commission.
(8) "Port director” means the Matanuska-Susitna Borough Port Director.
(9) "Port district” means those areas designated in MSB 18.02.020.
(10) "Strategic port development plan” means that plan, formulated through a systematic and continuing process, which enables the manager, with the concurrence of the port commission, to clearly determine objectives, direction and activities.
(11) "Tariff charges” means those charges included in a port tariff filed with the Federal Maritime Commission.
(12) "Users” means an entity leasing port district land, renting equipment or being charged for port services.
(13) "Vessel” means any type of ship, boat or navigable structure suitable for the transportation of property or persons, and the owner and master thereof.
(14) "Wharf” means a structure or platform of timber, masonry, earth or other material built usually parallel to the shoreline of the harbor extending outward to deep water, permitting vessels to berth, to discharge or receive cargo or passengers.

18.01.010 PURPOSE.
The Matanuska-Susitna Borough Port Commission, in order to develop and export the region’s natural resources, generate employment opportunities within the borough, attract capital investment by private enterprise, and promote importation/marshalling of bulk and/or project cargos, may develop, operate and maintain marine and industrial facilities of the port, encourage joint venture projects and meet the demands of the economy. Such activity of the port commission is meant to be consistent with general government policies of the borough as established by the assembly and implemented by the manager.
