CHAPTER 28.10: GENERAL PROVISIONS

28.10.030 Monitoring, violations, enforcement, and penalties
28.10.010 PURPOSE AND INTENT.
(A) It is the policy of the borough to promote the utilization of natural resources while protecting the health, safety, and welfare of its residents. This shall be done by utilizing the principals of best management practices that recognize social, environmental, and economic benefits when utilizing natural resources within the borough. None of these benefits is mutually exclusive of the others. The assembly recognizes that the extraction or harvest activities of natural resources vary widely from area to area, and resource to resource, depending on many natural or manmade factors. Natural resource utilization activities shall be based on the best available professional, scientific or technical standards to assure economic opportunities continue on both private and public land, while protecting the public’s health, safety, and welfare.

28.10.020 APPLICABILITY.
(A) To the extent allowed by law, this title applies to all landowners within the borough, unless otherwise specifically stated in this title.
(B) Unless otherwise specified by code, this chapter is applicable in all areas of the Matanuska-Susitna Borough outside the city limits of Houston, Palmer, and Wasilla.

28.10.030 MONITORING, VIOLATIONS, ENFORCEMENT, AND PENALTIES.
(A) Monitoring should occur to ensure compliance with this title.
(B) Unless specified otherwise, any violation of this chapter is an infraction.
(C) Remedies, enforcement actions, and penalties shall be consistent with the provisions of MSB 1.45.

28.10.040 FEES.
(A) The manager shall establish a schedule of fees for applications or permits required under this title. The assembly shall approve the fee schedule.
