CERTIFICATION OF ELECTION

3.36.010 Certification of election and discovery of prohibited conduct or discrepancies in returns.
A. At the next regular City Council meeting after completion of the canvass, the Council shall meet in public session to receive the report of the canvass board. If, after considering said report, the Council determines that the election was validly held, such conclusion shall be declared and entered upon the minutes of the meeting.
B. If the canvass board reports a failure to comply with provisions of State law or City ordinance, or that illegal election practices occurred and that such occurrence is sufficient to change the outcome of the election, the Council may declare the entire election invalid and order a new election.
C. If the canvass board reports an apparent discrepancy in the returns of one or more precincts, the Council may order a recount of the votes cast in said precinct(s). Such recount shall be conducted immediately by the canvassing board and the results reported to the Council. (Ord. 05-09 § 2, 2005)
3.36.015 Number of votes necessary to elect.
A candidate for the seat of Mayor, and a candidate for the seat of Council member, shall be elected when the candidate receives the largest number of votes cast for the seat. When there are two vacancies for the office of City Council the two candidates who receive the largest number of votes cast for those offices shall be elected. (Ord. 05-09 § 2, 2005)
3.36.020 Tie vote.
If there is a failure to elect because of a tie vote, the Council shall give notice to those candidates to appear at a public meeting where the election shall be determined fairly by lot among the candidates tying. (Ord. 05-09 § 2, 2005)
3.36.030 Certificate of election.
Upon certification of a valid election the Council shall authorize the Clerk to prepare and deliver to each person elected to office a “Certificate of Election” signed by the Clerk and authenticated by the seal of the City. (Ord. 05-09 § 2, 2005)
3.36.040 Oath of office.
All officers elected, before entering on the duties of office, shall take and subscribe the following oath and affirmation:
I, __________, do solemnly swear (or affirm) that I will support and defend the Constitution and laws of the United States, the laws of the State of Alaska, the charter and the ordinances of the City of North Pole, and that I will faithfully and honestly perform the duties of __________. SO HELP ME GOD.
