ALCOHOLIC BEVERAGES

5.10.010 Alcoholic beverage licenses.
Upon receipt of notification from the Alcoholic Beverage Control Board that the Board has before it an application for the issuance, renewal or transfer of an alcoholic beverage license for a location which is within the City of Saxman the Council shall determine whether to protest the proposed action as not in the best interest of the public, and shall consider such of the following factors as the Council believes are pertinent:
(a) The character and public interests of the surrounding neighborhood;
(b) Whether the business operated under the license has, or is eligible for, a zoning permit;
(c) Whether the business operated under the license is, or persons named on the application are, delinquent in the payment of any of the following:
(1) Sales tax or penalty or interest on sales tax arising from the operation of the business conducted under the license;
(2) Property taxes or penalties or interest on real or personal property applied to the business operated under the license;
(3) Charges for a City service provided for the benefit of the business conducted under the license;
(d) The comments and objections, if any, of the residents and property owners of the surrounding area;
(e) Whether the surrounding area experiences an unacceptable rate of crime or accidents in which alcohol is involved as a cause;
(f) The actual and potential law enforcement problems of the business conducted under the license, including the proximity of the premises to law enforcement stations and patrols;
(g) The history of convictions of persons named on the application for any felony or any criminal violation of State or local statute or regulation involving use or abuse of alcohol or a controlled substance. [Ord. 20-07 § 2].
5.10.020 Protested license applicant hearing.
If the Council decides to protest the issuance, renewal or transfer of a license it shall state the basis of the protest and the applicant shall be notified of such decision and shall be afforded an abbreviated and informal hearing before the Council to defend the application. At the conclusion of the hearing, the Council’s decision to protest the application shall stand unless a majority of the Council votes to withdraw the protest. Any protest must state the reasons for the protest and must be sent to the State of Alaska Alcoholic Beverage Control Board with a copy to the applicant. A protest must be received by the State of Alaska Alcoholic Beverage Control Board within 60 days of the City having received notice of the application. [Ord. 20-08 § 2].
