2.08.010 Appointment—Qualifications—Compensation—Bond.

A.    The council shall appoint by a majority vote of its members a city manager. He shall be chosen solely on the basis of his executive and administrative qualifications. He shall receive such compensation as the council shall determine. The city manager shall hold office at the pleasure of the council.

B.    The city manager shall, before assuming office, furnish bond in such sum and with such sureties as the council shall require, conditioned on the faithful performance of his duties as city manager. (Prior code § 2-3)

2.08.020 Powers and duties.

A.    The city manager shall be the executive and administrative officer of the city and shall assume such duties as assigned to the city manager elsewhere in this code. He shall supervise such administrative departments as may be established by ordinance for the effective control of city affairs. The city manager shall have the power to appoint and remove officers and employees of the city. The city manager may delegate to a department director or supervisor the power to appoint and remove officers and employees of his department. No member of the council shall interfere with or attempt to influence the exercise of such power.

B.    Other duties imposed upon the city manager are those necessary to furnish complete executive direction of the administrative service of the city. He shall:

1.    Prepare and recommend to council an annual budget;

2.    Execute and enforce all ordinances, resolutions and motions of the city council and carry out all contracts entered into by the city;

3.    Make such recommendations to the council as he may deem expedient or necessary and once a year present a detailed statement of what he has done during the year covered by the report;

4.    Perform such other duties as may be assigned to him by council and other such duties as are set out by this code; and

5.    Serve as ex officio member without vote of all city boards and commissions. (Prior code § 2-4)

2.08.030 Temporary appointment—Vacancy in office.

During the absence of the city manager, he shall appoint an acting city manager. Such appointment during an extended absence shall only be upon approval by city council. If the office of manager becomes vacant, council shall appoint without delay either a new manager or an acting manager to fill the office until a new manager is chosen. (Prior code § 2-5)

2.08.040 Regulation of personnel.

A.    The city manager shall have the power, subject to council approval, to make or amend rules and regulations relating to hiring and discharge, working conditions, hours and terms of employment, retirement and insurance plans, classification, compensation, leave and the like of all of the employees of the city; except, that no rule or regulation shall contravene the principles that the employment of city personnel shall be on the basis of merit and fitness and that there shall be no discrimination in any manner based on race, color, age, sex, religious creed, national origin, political affiliation, marital status, pregnancy, parenthood, disability or other criteria prohibited by law, except when the essential requirements of the position constitute a bona fide occupational qualification necessary to proper and efficient performance, and such performance cannot be accomplished through reasonable accommodations.

B.    These rules and regulations shall be on file and available for inspection in the office of the city clerk and shall also be available in booklet or pamphlet form entitled “City of Valdez—Personnel Regulations.” (Ord. 08-03 § 1; prior code § 2-6)

2.08.050 Departments—Divisions—Transfers of functions—Utilities and municipal enterprises.

A.    The city manager shall have the power, subject to council approval, to create and abolish offices, departments or agencies other than offices, departments and agencies established by this code. The city manager may assign additional functions or duties to officers, employees, departments or agencies and may likewise transfer functions or duties from such office, position, department or agency to another. The city manager may transfer employees from one department to another. The work of departments may be distributed among such divisions thereof as may be established by the city manager.

B.    The city manager shall administer and manage such utilities and other such municipal services or enterprises by means of such officers and employees as he shall appoint and subject to the provisions of this code. (Prior code § 2-7)
