AIRCRAFT REGULATIONS

17.110.030 Aircraft operations prohibited – Exceptions.
17.110.010 Purpose.
The purpose of these regulations is to protect the health, safety, and welfare of the citizens and visitors of the Town of Pinetop-Lakeside, and to preserve the quiet, mountain environment of the Town. (Ord. 15-393 § 1 (part): Ord. 08-315 § 1)
17.110.020 Definitions.
A. "Aircraft" means manned or unmanned airplanes including helicopters, amphibious airplanes, or any other craft used for navigation through the air, but excludes radio-controlled aircraft weighing less than two hundred fifty (250) pounds.
B. "Operation(s)" means a takeoff, a landing, or helicopter hover testing. (Ord. 15-393 § 1 (part): Ord. 08-315 § 1)
17.110.030 Aircraft operations prohibited – Exceptions.
Aircraft operations are prohibited within the Town limits, except:
A. In the case of a declared emergency landing as defined in the Federal Aviation Regulations; or
B. As part of the emergency response of a medical, wildfire, or law enforcement aircraft, or aircraft owned and operated by the state or a political subdivision of the state for that emergency purpose; or
C. In the case of special events allowing the use of aircraft for educational or charity events and fundraisers, if the use is approved in advance by special event permit expressly authorizing the use of aircraft with any special conditions imposed by the Director; or
D. Aircraft operations for construction activities, if the use is approved in advance by special event permit expressly authorizing the use of aircraft with any special conditions imposed by the Director. (Ord. 15-393 § 1 (part): Ord. 08-315 § 1)
17.110.040 Regulations.
A. Purpose. As a matter of health, safety, and welfare of the citizens and visitors to the Town, this section is intended to regulate the takeoff, landing, and other aircraft operations which currently operate within the Town of Pinetop-Lakeside as legal nonconforming uses or otherwise legally on the date the ordinance codified in this chapter is effective.
B. Regulations in C-2 Zoning Areas.
1. The minimum parcel size for a helicopter takeoff/landing area in a C-2 zoning district shall be one (1) acre.
2. The minimum setbacks for a takeoff/landing area in a C-2 zoning area shall be a minimum of ninety (90) feet from the center of the helicopter landing pad to any property line.
3. The hours of operation for helicopter takeoffs, landings, or hover operations in a C-2 zoning district shall be Monday through Friday only, 8:00 a.m. to 4:00 p.m.
4. The maximum number of aircraft operations (which shall not include helicopter hover testing and engine testing) in a C-2 zoning district shall be six (6) operations per day.
5. The number of aircraft operations (which shall not include helicopter hover testing and engine testing) in a C-2 zoning district shall not exceed fifteen (15) per week or fifty (50) per month.
6. Approaches and departures shall be carried out over areas that will have a minimum impact or interference with persons and property on the ground, and all helicopter operations including takeoffs and landings shall be performed in compliance with applicable Federal Aviation Regulations.
