8.30.010 General.

No person shall negligently make, continue, permit or cause to be made or continued any unreasonable, excessive, unnecessary, or unusually loud noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the town limits. 8.30.020 Construction noise.

A. The erection (including excavation), demolition, alteration or repair of any building, as well as the operation of any pile driver, steam shovel, pneumatic hammer, derrick, steam or electric hoist, or any other similar equipment attended by loud or unusual noise, other than between the hours of 6:00 a.m. and 6:00 p.m., shall be unlawful; provided, however, the town manager or his/her designee shall have the authority, upon determining that the loss or inconvenience which would result to any party in interest would be extraordinary and of such nature as to warrant special consideration, to grant a permit for a period necessary within which time such work and operation may take place within the hours of 6:00 p.m. to 6:00 a.m.

B. From April 15th to October 15th inclusive, concrete may be poured each day between the hours of 5:00 a.m. and 7:00 p.m. or at such other times as authorized by permit. From October 16th to April 14th inclusive, concrete may be poured each day between the hours of 6:00 a.m. to 7:00 p.m. or at such times as authorized by permit. 8.30.030 Exemptions.

Noise made for the following purposes shall not be considered violations of this chapter:

A. Emergency activities necessary to restore property to a safe condition after a natural disaster or occurrence;

B. Protecting people or property from imminent danger;

C. Governmental activities;

D. Activities sponsored or sanctioned by the town council or town manager or his/her designee;

E. The reasonable use of amplifiers or loudspeakers in the course of public addresses which are noncommercial in nature. [Ord. 1998-12; prior code § 14-1-3.]

8.30.040 Penalties.

A violation of any provision of this chapter is a civil infraction and shall be adjudicated by the town magistrate. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. [Ord. 1998-12; prior code § 14-1-4.]
