8.10.010 Definitions.
For the purpose of this chapter:
“Junk motor vehicle” means any motor vehicle, the condition of which is wrecked, dismantled, partially dismantled, inoperative, or from which the wheels, engine, transmission or other substantial part thereof has been removed.
“Motor vehicle” means any vehicle which is self-propelled and designed to travel along the ground and includes, but is not limited to, automobiles, motor homes, buses, motor bikes, motorcycles, motor scooters and trucks, which are required to be registered and licensed with the Arizona State Department of Motor Vehicles. 8.10.020 Storing, parking or leaving on private property unlawful.
It is unlawful for a person to park, store, leave, or permit the parking, storing or leaving of any junk motor vehicle for a period in excess of five days upon any private property within the town; provided, however, that the provisions of this chapter shall not apply to any junk motor vehicle:
A. In an enclosed building or an area completely screened from view by fencing, shrubbery, or other screening deemed appropriate by the town; or
B. The premises of a business enterprise which is properly operated in the appropriate zoning district pursuant to the zoning laws of the town. [Ord. 50 § 2, 1998. Code 1983 § 8-2-2.]
8.10.030 Disabled vehicles on public right-of-way unlawful.
It is unlawful for the owner or any person having control of a motor vehicle which is inoperable or disabled to allow the motor vehicle to remain parked or located upon the paved or unpaved portion of any street or alley within the town for a period of time in excess of 72 hours. In the event that the owner or person having control of the vehicle cannot be readily located, then the town may cause the vehicle to be removed from the public right-of-way pursuant to the provisions of A.R.S. sections 28-4831, 28-4833 and 28-4134. 8.10.040 Violation – Penalty.
A violation of any provision of this chapter is a Class 2 misdemeanor. [Ord. 50 §§ 2, 4, 1998. Code 1983 § 8-2-4.]
8.10.050 Enforcement authority.
The provisions of this chapter shall be enforced by the town manager, or a designee, or any police officer. Complaints shall be filed in the town court. [Ord. 50 § 2, 1998. Code 1983 § 8-2-5.]
