10.15.140 Enforcement – Generally.
10.15.010 Method of parking.
Except as otherwise provided by resolution of the council, every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be stopped or parked with the right-hand wheels of such vehicle parallel to and within 18 inches of the right-hand curb. [Code 1983 § 10-3-1.]
10.15.020 Blocking traffic.
A. It shall be unlawful for any person to stop, stand or park any motor vehicle or other vehicle upon a street in the town in such manner or under such conditions that restrict the free movement of vehicular traffic, except that a person may stop temporarily, in the actual loading or unloading of passengers, or when necessary, in the observance of traffic signs or signal of the police chief.
B. It shall be unlawful for any person to park a motor vehicle, or other vehicle, within an alley or entrance to a private driveway except for the loading or unloading of materials, and not then unless such loading or unloading can be accomplished without blocking the alley to the free movement of vehicular traffic. 10.15.030 Parking adjacent to schools.
When signs are erected indicating no parking on that side of the street adjacent to any school property, no person shall park a vehicle in any such designated place for one hour before school opens until one hour after school closes on any school day. [Code 1983 § 10-3-3.]
10.15.040 Authority to erect signs restricting parking.
The police chief, upon approval by the council, may erect signs requiring parking at an angle to the curb, allowing parking on the left-hand curb on one-way streets, notifying drivers that parking is prohibited by ordinance, and restricting parking in any way that may be necessary. When such signs are erected, no person shall stop or stand a vehicle in disobedience to such signs. [Code 1983 § 10-3-4.]
10.15.050 Parking vehicles on sidewalk.
It is unlawful for any person to park any vehicle, whether in usable condition or not, or for an owner to permit his vehicle to be parked upon any sidewalk in the town. [Code 1983 § 10-3-5.]
10.15.060 Abandoned vehicles.
Any vehicle remaining parked upon any sidewalk of the town for more than three days, or any disabled vehicle remaining parked upon any street of the town for more than seven days, is declared to be an abandoned vehicle and the police shall forthwith remove the same from the sidewalks or streets of the town at the expense of the owner of such vehicle. 10.15.070 Emergency vehicles.
The driver of any authorized emergency vehicle including police, fire or ambulance vehicle, when responding to an emergency call or when in pursuit of an actual or suspected violator of the law, or when responding to a fire alarm or call for an ambulance, may exercise the following privileges subject to the conditions stated:
A. Park or stand irrespective of the provisions of this title.
B. Proceed past red or stop signals or stop signs after slowing down as may be necessary for safe operation.
C. Exceed the prima facie speed limits so long as life and property is not endangered.
D. Disregard regulations governing direction of movement or turning in specified directions.
The exemptions granted by this section shall apply only when the driver of the emergency vehicle sounds audible signals by bell, siren or exhaust whistle as may be reasonably necessary, and when the vehicle is equipped with at least one lighted lamp displaying a red light visible at least 500 feet to the front of the vehicle.
The provisions of this section shall not relieve the driver of an authorized emergency vehicle from their duty to drive with due regard for the safety of others, nor protect the driver from consequences of his reckless disregard for the safety of others. [Code 1983 § 10-3-7.]
10.15.080 Handicapped areas.
A. Insignia Display. No person shall park a vehicle in a parking space on either public or private property set aside and identified for use only by persons with physical disabilities, unless the vehicle has displayed thereon a distinguishing insignia as provided in A.R.S. section 28-881.
B. Identified Spaces. Subsection (A) of this section shall apply only to those parking spaces that are identified with standard signs or other markers, as approved by the police.
C. Consent for Enforcement. Any person or business which causes a parking space to be set aside for use only by persons with physical disabilities and identifies such parking space by the methods described in subsection (B) of this section shall be deemed to have given consent to the police to enforce a violation of this section, when such violation occurs on the private property of such person or business. 10.15.090 Parking on private property.
It is unlawful for any person to park a vehicle, fully or partially, in any private driveway, on private property or on private parking areas without the express or implied consent of the owner or person in lawful possession of such premises. [Ord. 2023-02.]
10.15.100 Stopping, standing, or parking prohibited.
No person shall stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of an authorized enforcement agent or traffic control device, either on public or private property, in any of the following places:
A. Within 15 feet of a fire hydrant.
B. In any area designated as a fire lane.
C. In any area designated as prohibiting stopping, standing, or parking.
D. Within a marked school crossing zone designated by appropriate device, marks or lines upon the surface of the roadway. [Ord. 2023-02.]
10.15.110 Trailer or semi-trailer parking.
It is unlawful for trailers or semi-trailers designed or intended to be drawn behind a motor vehicle to be parked upon a street, alley, or other public right-of-way for a period of time longer than two hours, except commercial vehicles may be parked for a longer period of time only when such parking is necessary while actually carrying out a lawful commercial purpose. At no time shall any trailer or semi-trailer, attached or not to a truck, tractor, vehicle or other conveyance, be parked so as to block a lane of travel on a public street, or otherwise interfere with the safe and efficient movement of traffic. 10.15.120 Parking for certain purposes prohibited.
It is unlawful for any person to park a vehicle upon any portion of the town’s right-of-way for the purpose of:
A. Displaying such vehicle for sale (except as permitted per TTC 9.05.260);
B. Washing, greasing, or repairing such vehicle except repairs necessitated by any emergency;
C. Displaying advertising;
D. Displaying commercial exhibits; or
E. Sale of any services or merchandise. [Ord. 2023-02.]
10.15.130 Violations.
A. Except as otherwise specified, violation of any provision of this chapter is a civil traffic offense.
B. With respect to a violation that is continuing in nature, each day that the violation occurs is a separate offense.
C. Violation of this chapter may also result in the vehicle involved in the violation being towed at the owner’s expense. [Ord. 2023-02.]
10.15.140 Enforcement – Generally.
A. It shall be the duty of each individual who is authorized to issue notice of violations to keep account of all violations of this chapter and to take the following actions:
1. Identify the violation and the employee who issued the violation;
2. Report the date, time and location of the violation;
3. Report the state license plate number of any vehicle that is in violation of this section;
4. Report any other facts or knowledge which is necessary to a thorough understanding of the violation and its attending circumstances. [Ord. 2023-02.]
