1.24.010 Sale of city land for post office construction.
At its meeting of November 20, 1984, the city council, city of Benicia, found that city land, commonly known as Sanborn Field, has since its acquisition been used for a ball field and other recreational uses, and that the city has been approached by the United States Postal Service to acquire a portion of Sanborn Field for the construction of a new city postal facility, and, whereas, in order to accomplish this goal it is necessary that the city convey the property to the United States Postal Service in order to establish a more convenient location and to provide more efficient service to the residents of the community; and pursuant to the findings and Government Code Section 37111, the city council does authorize the sale of a portion of the Sanborn Field to the United States Postal Service for the purpose of construction and erection of a post office facility; provided, however, that the sale of the parcel be conditioned upon the following:
A. That the city reserves the right to participate in architectural review of any building on the parcel;
B. That the agreement of sale contain a provision allowing the city the first right to purchase the property and improvements from the postal service in the event it ceases use as a post office;
C. That the proceeds derived from the sale of the parcel be used to develop softball fields and other recreational facilities at the Benicia Middle School, and that any excess proceeds after such expenditure shall be placed in the recreation department budget for further development and maintenance of recreational facilities.
