STREET IMPROVEMENTS BY RAILWAYS

12.20.010 Requirements.
In all cases where the rails, track, or tracks of any railway corporation cross any open travelled street in the city, the owners or lessees thereof, their agents, officers, directors or managers must, at its or their own expense and within 10 days after having been so notified in writing by the superintendent of streets, commence or cause to be commenced the grading, macadamizing or graveling to the official grade of the city, all that portion of such street or streets, exclusive of sidewalks, as may be included within the exterior lines of the right-of-way of such railway corporation, and prosecute such work diligently and continuously to completion, within 30 days after the service of such notice or within such further time as the city council may by resolution grant. All of the macadamizing shall be of hard stone and gravel and done in a good and workmanlike manner, and any railway corporation must also in like manner and within the same time commence and construct, at its or their own expense, plank sidewalks of the official width and structure, and stone gutters along both sides of the portion of the streets so improved by the corporation or other aforesaid. All of the work shall be under the general direction of and to the satisfaction of the superintendent of streets. (Ord. 115 M.C. § 1, 1886).
12.20.020 Administration.
The superintendent of streets is authorized and directed to notify the owners, lessees or others as above of any railway corporation whose road may cross any street referred to in this chapter, to comply with all the terms and conditions of this chapter within the time and in the manner specified in this chapter. (Ord. 115 M.C. § 2, 1886).
12.20.030 Violation.
It is a violation of this code for any owner, lessee, agent, officer, director, or manager of any railway corporation operating its road in the city and crossing any street referred to in this chapter, to neglect or refuse to commence and complete the macadamizing, graveling and constructing of sidewalks and gutters as required in this chapter, within the time and in the manner specified.
