13.72.010 Necessity.

Where a public sewer is not available within the proximity limits set forth in BMC 13.60.001, the applicant may elect to construct and maintain a private sewage disposal system, approved by the city. (Prior code § 7-691).

13.72.020 Permit requirements.

A. A permit is necessary to construct, reconstruct or alter a private sewage disposal system. The applicant for a permit for construction of a private sewage disposal system shall:

1. Execute an agreement to make no protest of assessment district proceedings or other legal proceedings undertaken for improvement of the public sewerage system;

2. Obtain a permit for construction of a private sewage disposal system from the county department of public health; and

3. Comply with all design criteria and permit provisions of the county health department.

B. No premises to be served by a private sewage disposal system may be occupied until final inspection and approval of the system by the county health department and the director. (Prior code § 7-692).

13.72.030 Operation and maintenance.

The owner shall operate and maintain private sewage disposal facilities in a safe and sanitary manner at all times at no expense to the city. (Prior code § 7-694).

13.72.040 Availability of public sewer – Abandonment of facilities.

When a public sewer becomes available to property served by a private sewage disposal system, the owner shall make a direct connection to the public sewer in compliance with this division and the rules and regulations of the city. Septic tank, cesspool, and similar private sewage disposal facilities shall be abandoned and filled with a suitable material as determined by the director. (Prior code § 7-693).
