14.320.010 Purpose.

The C-G general commercial district provides areas for a variety of commercial uses which serve the needs of residents in Biggs as well as the surrounding region. Residential uses are allowed with a use permit at densities not less than 16.0 and not more than 25.0 units per gross acre. This district allows the greatest range of commercial uses within Biggs and is intended to provide goods and services for the community as well as employment for local residents. [Ord. 428 § 3 (Exh. 14.320.020 Permitted uses.

Land may be used in the C-G general commercial district as provided for in Chapter 14.300 BMC (Commercial Use Table). [Ord. 409 § 3, 2017; Ord. 320 § 1, 1999. Formerly 14.130.020]

14.320.030 Conditional uses.

Land may be used, subject to securing a use permit, within the C-G district as provided for within Chapter 14.300 BMC (Commercial Use Table), and in accordance with provisions of Chapter 14.60 BMC (Conditional Use Permits). [Ord. 409 § 3, 2017; Ord. 320 § 1, 1999. Formerly 14.130.030]

14.320.040 Setbacks, lot dimensions, lot coverage, and building height.

Setback for lot boundaries fronting public roads, minimum lot sizes, maximum lot coverage and maximum height restrictions are required for all lots within the C-G district as follows:

(1) Where the frontage in a block is partially in a residential district, the front yard setback for a lot in the C-G district shall be the same as required in the residential district.

(2) Side Setback. A side setback shall not be required except, where the side of a lot in the C-G district abuts a residential district there shall be a side yard setback of not less than 15 feet. However, where an alley separates the side yard of a commercial lot from a residential district, no side yard setback shall be required in the commercial lot.

(3) Side Yard Street Frontage. A side yard setback shall be required as follows where the side yard fronts a public road:

(a) A minimum setback of 10 feet shall be maintained where a side yard in the C-G district fronts a public road, except where such road is an alley.

(b) Where frontage in a block is partially in a residential district, any side yard in the C-G district which fronts on to a street shall maintain a setback equal to that required along the adjacent street frontage in the residential district.

(4) Rear Setback. A rear setback shall not be required except, where the rear of a lot in the C-G district abuts a residential district there shall be a rear yard setback of not less than 15 feet. However, where an alley separates the rear yard of a commercial lot from a residential district, no rear yard setback shall be required in the commercial lot.

(5) An additional 15 percent lot coverage (total lot coverage of 90 percent) may be allowed through the issuance of a conditional use permit.

(6) No building or structure erected on property in the C-G district shall have a height greater than 55 feet. Such height limitation may be exceeded by appurtenances necessary to the operation of any permitted use. The planning commission may, however, grant an exception, subject to the provisions of Chapter 14.180 BMC (Exceptions), to allow a structure or building to be erected to a height not to exceed 55 feet. 14.320.050 Landscaping requirements.

Landscaping requirements shall be established through the project review process as required under Chapter 14.100 BMC (Design Review). However, a minimum of 10 percent of a lot shall be improved landscape accessible to the public. [Ord. 409 § 3, 2017; Ord. 320 § 1, 1999. Formerly 14.130.070]

14.320.060 Special development regulations.

A solid wall or fence with a minimum height of six feet shall be installed on any property line within the C-G district that is common to any residential district.
