2.14.010 Authorization.

There is established a Police Department for the City. (Ord. 391 § 1, 1983).

2.14.020 Administration – Chief of Police.

Administration of the Police Department shall be the responsibility of the Chief of Police, who shall be appointed by and report to the City Manager. (Ord. 470 § V, 1992; Ord. 391 § 1, 1983).

2.14.030 Organization.

Subject to the number and classification of personnel authorized by the Council, the Chief of Police shall, in the manner prescribed by law, appoint personnel to the Police Department. (Ord. 391 § 1, 1983).

2.14.040 Responsibilities.

A. The Chief of Police shall provide for the maintenance of order and discipline within the Police Department. To that end, the Chief of Police shall prepare such department regulations as may be necessary, subject to approval of the Council.

B. It shall be the responsibility of the Chief of Police to plan and provide for the enforcement of laws, to apprehend violators, to discharge other duties and responsibilities that may be required by law, and to perform such other duties as may be lawfully assigned by the Council. (Ord. 391 § 1, 1983).

2.14.050 Reserve police officers.

A. The Chief of Police is authorized to maintain a reserve police force and may appoint persons to the position of reserve police officer who meet the standard qualification formats as set by the Commission on Peace Officer Standards and Training (POST), and the Department’s rules and regulations. Such reserve officers shall serve at the pleasure of the Chief.

B. Appointment will be to one of four classifications of reserve police officer:

1. Designated Level I. Any officer granted this classification has peace officer status 24 hours a day, under Penal Code Section 830.1, providing the officer has met the training and education requirements set forth in the California Penal Code.

2. Level I. Any officer granted this classification has peace officer status while on duty under Penal Code Section 832.6(a)(1), providing the officer has met the training and education requirements set forth in the California Penal Code.

3. Level II. Any officer granted this classification has peace officer status while on duty under Penal Code Section 832.6(a)(2), providing the officer has met the training and education requirements set forth in the California Penal Code.

4. Level III. Any officer granted this classification has peace officer status while on duty under Penal Code Section 832.6(a)(3), providing the officer has met the training and education requirements set forth in the California Penal Code.

C. Consistent with the training requirements provided in the California Penal Code, nothing shall prohibit the Chief of Police from upgrading or downgrading the reserve officer’s classification, based on training and performance or other factors affecting the officer’s performance on duty.

D. Nothing shall prohibit reserve officers from being compensated from time to time for their services in certain situations.

E. The Chief of Police shall, in addition to departmental procedures and regulations, provide rules and regulations covering conduct and authority of the reserve officers. (Ord. 391 § 1, 1983).

2.14.060 Training.

In conformance with the provisions of California Penal Code Section 13522, while receiving any State aid pursuant to Chapter 1 of Title 4, Part 4 of the California Penal Code (commencing with Section 13500), the City will adhere to the standards for recruitment and training as established by the California Commission on Peace Officer Standards and Training (POST). The Police Department shall collect and retain such data and information as is necessary to verify that the Calistoga Police Department’s personnel adhere to the standards for recruitment and training established by the Commission on Peace Officer Standards and Training and shall make such information available to the Commission when requested. 2.14.070 Acquisition, possession, use, and reporting of military equipment.

In conformance with the requirements of Government Code Sections 7070, 7071, and 7072, the Chief of Police will develop a policy for the approval, acquisition, and reporting requirements of military equipment. This policy shall be approved by the City Council pursuant to Government Code Section 7071. The military equipment policy will minimally provide guidance for the following:

A. Approval by City Council for any purchase, acquisition, or allocation of any funds for military equipment defined in Government Code Section 7070;

B. Maintaining a list of equipment qualifying as military equipment defined in Government Code Section 7070(c);

C. Submission of an annual report to the City Council for each type of military equipment approved within one year of approval for renewal of approval and annually to occur before May 1st of each subsequent year for as long as the military equipment is available for use per Government Code Section 7072; and

D. Hold at least one well-publicized community engagement meeting within 30 days of submitting and publicly releasing the annual report. The purpose of the public hearing is to allow for public questions regarding the funding, acquisition, and use of military equipment. (Ord. 756 § 3, 2022).
