It shall be unlawful to engage in the following actions including but not limited to erect, construct, alter, repair, remove, demolish or utilize or occupy a building or premises or system regulated by this title, in conflict with or in violation of any of the provisions of this title. 15.52.020 Notice of violation.
When the Building Official or the Fire Code Official finds that a building, premises, vehicle, storage facility or outdoor area is in violation of this title, the Building Official or Fire Code Official shall prepare a written notice of violation describing the unlawful conditions and, if applicable, specifying a date for remediation of such conditions.
A. Service. Whenever notice to a property owner is required to be given by this chapter, it shall be made as follows:
1. Notice shall be served by mailing a copy of the notice to the owner of record by certified mail. Determination of the owner of record shall be based on the last equalized assessment roll or the supplemental roll, whichever is more current. A copy of the notice shall also be conspicuously posted in front of the property on which the violation exists, or if posting on the front of the property is not possible, then the notice may be posted in any other location of the property wherein it will be most likely to give notice to the owner.
2. Compliance with Orders and Notices. After being notified of the unlawful conditions in the manner prescribed in this section, the owner, operator, occupant or other person responsible for such conditions shall comply with the notice of violation and any orders set forth therein by the date indicated in the notice.
3. Prosecution of Violations. Failure to comply with the notice of violation or any orders set forth therein shall constitute a violation of this code.
4. Unauthorized Tampering. Signs, tags or seals posted or affixed by the Building Official or Fire Code Official shall not be mutilated, destroyed, tampered with or removed without authorization from the Building Official or Fire Code Official. (Ord. 646 § 4, 2007).
15.52.030 Violation penalties.
Persons who violate a provision of this title or who otherwise fail to comply with any of the requirements herein shall be subject to penalties as prescribed in Chapter 1.08 CMC. (Ord. 646 § 4, 2007).
