ATTORNEYS’ FEES AND COSTS

4.25.010 Declaration of purpose.
The city council finds that there is a need to recover costs and fees incurred by the city to abate public nuisances. The city council further finds that the recovery of attorneys’ fees in nuisance abatement actions and proceedings will further the strong public policy of encouraging the abatement of public nuisances in the city, will facilitate the city’s efforts to maintain effective and efficient nuisance abatement programs within the city and will, accordingly, serve as an effective deterrent to the maintenance of public nuisances. 4.25.020 Recovery of attorneys’ fees.
Pursuant to California Government Code Section 38773.5, or its successor statutes, in any action, administrative proceeding or special proceeding to abate a public nuisance wherein the city elects at the initiation of the action or proceeding to seek recovery of its attorneys’ fees, the prevailing party shall be entitled to recover the amount of its reasonable attorneys’ fees incurred in the action or proceeding.
