FOWL – REGULATIONS CONCERNING SALE, RELEASE AND FEEDING

6.20.010 Definitions.
A. “Restricted area” means within the city, the wharf, the Soquel Creek streambed, the lagoon located at the mouth of the creek during portions of the year, and any area within forty feet of the streambed or lagoon.
B. “Waterfowl” means and refers to any ducks, geese or other birds which can be found in the Soquel Creek, which have used the creek as a habitat, or are reasonably capable of using the creek as a habitat. (Ord. 912 § 2, 2006)
6.20.020 Restricted feeding area – Prohibitions.
It is prohibited, in the restricted feeding area, to feed waterfowl or pigeons, or to place or release food which may be consumed by waterfowl or pigeons, without the express written permission of the city manager. It is also prohibited for any adult to allow any minor in his or her care or custody to allow such feeding by the minor. (Ord. 912 § 2, 2006)
6.20.030 Selling prohibited.
It is prohibited, in the city, to sell or offer to sell (or conduct a business in which there is a sale or offer to sell) live waterfowl or pigeons as pets or for release. (Ord. 912 § 2, 2006)
6.20.040 Releasing in restricted area prohibited.
Abandoning or releasing of any waterfowl or pigeons in the restricted area is prohibited. (Ord. 912 § 2, 2006)
6.20.050 City manager permission.
The city manager may grant permission to feed or release waterfowl upon a reasonable showing of some health, wildlife management or stream management reason to justify the activity. (Ord. 912 § 2, 2006)
