9.20.010 Definitions.

For the purposes of this chapter, the following phrases shall have the meanings stated in this section:

A. “Alcoholic beverage” means and includes alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, or beer, and which is fit for beverage purposes, either alone or when diluted, mixed, or combined with other substances.

B. “Public place” means any public street, right-of-way, alley, Devendorf Park; any publicly used exterior grounds of a service station or parking lot; any school or school ground; any public assembly hall or auditorium; any municipal chambers, post office or library. The City Council shall have the right to make exceptions to this definition for designated places for specific events of limited duration, through adoption of a resolution. 9.20.020 Drinking in Public Places.

It is unlawful for any person to drink any alcoholic beverage in or upon any public place, as defined in this chapter, within the City. The Sunset Center Theater and the attached buildings and grounds are exempt from the definition of public place as used in this Chapter; provided, however, that any public consumption of alcoholic beverages at Sunset Center allowed by this exemption shall only be permitted if it is by persons attending events booked at Sunset Center and is in connection with such events. 9.20.030 Prohibited on Public Beaches After 10:00 p.m.

No person may serve, possess or consume alcoholic beverages of any kind on the public beach or slopes leading thereto in the City after the hour of 10:00 p.m. This prohibition is applicable to all that beach and slope area lying west of San Antonio Avenue as it extends to the north from Ocean Avenue, to the northern City boundary and west of Scenic Road, from Ocean Avenue to the southern City boundary. This prohibition against the possession or consumption of alcoholic beverages shall extend from 10:00 p.m. on the day it commences until 7:00 a.m. the following day.
