13.16.010 Monterey County Code Adopted.

Chapter 15.08 Monterey County Code, Water Wells, is adopted in its entirety except for Sections 15.08.130 and 15.08.140(B) and the amendments addressed in this chapter. (Ord. 92-13 § 2 (Exh. A), 1992).

13.16.020 Access to Well Site.

In addition to the access requirements of the County Code, a condition of any permit issued under this chapter is that the City shall have access to the site for the purpose of verifying compliance with this chapter. (Ord. 92-13 § 2 (Exh. A), 1992).

13.16.030 Notice to the Public Works Department.

A copy of permit applications submitted to the County under the provisions of this chapter shall be forwarded to the City Department of Public Works at the time of initial application. (Ord. 92-13 § 2 (Exh. A), 1992).

13.16.040 Appeal to City Council.

Section 15.08.160 of the County Code is amended such that the words “Board of Supervisors” are replaced with the words “City Council of the City of Carmel-by-the-Sea,” “Board” is replaced with “City Council,” and “(Fee Ordinance: Monterey Code 10.08.050 BB)” is deleted, for all wells within the City’s jurisdiction. (Ord. 92-13 § 2 (Exh. A), 1992).

13.16.050 Civil Enforcement – Notice of Violation.

Section 15.08.190 of the County Code is amended such that the words “Board of Supervisors” are replaced with the words “City Council of the City of Carmel-by-the-Sea,” and “(Fee Ordinance: Monterey Code 10.08.050 BB)” is deleted, for all wells within the City’s jurisdiction. (Ord. 92-13 § 2, 1992).

13.16.060 Civil Enforcement – Nuisance.

Section 15.08.200 of the County Code is amended such that the words “County Council” are replaced with the words “City Attorney,” “Board of Supervisors” is replaced by “City Council of the City of Carmel-by-the-Sea,” and “County” is replaced by “City of Carmel-by-the-Sea.” (Ord. 92-13 § 2, 1992).
