9.80.010 Definitions.

As used in this chapter:

(a) “Public right-of-way” means any place or way set aside or open to the general public for purposes of vehicular traffic, including any berm or shoulder parkway, or median strip thereof and any area or way set aside or open to the general public for purposes of pedestrian traffic, whether or not it is paved.

(b) “Vehicle” means and includes every wagon, cart, push cart, coach, carriage, omnibus, automobile, cycle, car, motorcycle, truck, trailer, tractor engine, tractor or other conveyance or contrivance for moving persons, animals or things in whatever manner and by whatever force or power the same may be ridden, driven, propelled, drawn or moved, which is driven, propelled, drawn or moved on a public right-of-way. 9.80.020 Prohibition on peddling or selling products near schools.

It is unlawful for any person to peddle or sell any goods, wares, or liquids or edibles for human consumption from vehicles in the public right-of-way within one thousand feet from any public or private school property, during school hours or one hour before or one hour after school hours. 9.80.030 Exemption.

Persons peddling or selling pursuant to a validly issued city parade/special event permit shall be exempt from the provisions of this chapter. (Ord. 834 § 1 (part), 2001)

9.80.040 Penalty—Infraction.

Any person violating any of the provisions of this chapter shall be deemed guilty of an infraction punishable by fine as follows:

(a) Upon a first violation the person shall receive an infraction citation punishable by a fine of fifty dollars.

(b) Upon a second violation occurring within a twelve-month period following the first violation, the person shall receive an infraction citation punishable by a fine of one hundred dollars.

(c) Every violation occurring after the second violation, and within a twelve-month period following the first violation, shall be punishable by a fine of two hundred fifty dollars. (Ord. 834 § 1 (part), 2001)
