16.04.010 Purpose.

This chapter is enacted in order to insure that the purchasers of residential properties within the city will be fully advised of the exact nature of the purchase, including information relating to the zoning of surrounding properties and the city’s adopted general plan of land use, as well as the prevention of misleading information about the quality of residential construction. 16.04.015 Model homes.

All model homes constructed for sales purposes in a residential subdivision shall be built in exact accordance with the building construction plan submitted and approved for all structures to be built in the subdivision. No change, alteration or increase in quality or quantity of construction materials or decorator finishes, shown on the approved building plans, shall be permitted in a model home, unless every such change, alteration or increase is plainly marked by signs at the location of the change, containing letters and numbers of not less than two inches in height setting forth the exact differences in specifications. Those items installed in the model by the developer as decorator items (not for sale) and optional accessory furnishings or materials shall likewise be marked with signs of not less than two inch letters, indicating such to prospective purchasers. 16.04.020 Furnishing of planning and zoning information.

Every person, firm or corporation selling, or offering for sale, residential property within an approved subdivision tract in the city shall attach, affix or otherwise incorporate into all printed matter relating to sales information about the residential properties, copies of the latest revised edition of the city’s general plan of land use and latest revised edition of the city’s zoning map. These materials shall bear the date of approval and the signature of the secretary of the planning commission; provided, however, that there is exempted from the provisions of this section the resale or offering for resale of residential property when the appurtenances of the property to be resold have been actually used for residential purposes for a period of six consecutive months or more prior to the resale or offer of sale. 16.04.030 Penalty.

Whoever violates the provisions of this chapter is guilty of a misdemeanor and if found guilty punished in accordance with the provisions of Section 1.08.010, et seq., of the Cerritos Municipal Code. (Ord. 455 § 2 (part), 1973)
