22.70.010 Definitions.

Unless the context otherwise requires, words and phrases used in this chapter shall have the same meanings as when used in this code:

(1) A “residential structure” is defined as any structure or building being used for residential purposes or located on a residentially zoned parcel, or any part of such a structure or building including, but not limited to, siding, stucco, trim, and accent features such as doors, gates, and shutters.

(2) A “color palette” is defined as the official city document which exhibits all of the colors, organized by color family and displayed according to corresponding specific design elements, that are approved for use on the exterior of any residential structure. A copy of the approved color palette shall be kept, for referential use, both at the city library and at the department of community development.

(3) A “paint color permit” is defined as the document issued by the department of community development that indicates the approval of the application of paint colors from the color palette on a residential structure. The paint color permit lists the colors approved for the specific design elements featured in the color palette. The painting of a residential structure without prior obtainment of a paint color permit shall constitute an infraction punishable pursuant to Section 1.08.020 of this code.

(4) A “decorative masonry building material” is defined as a decorative building material including, but not limited to, brick, stone, and block, typically located on the exterior surface of a residence.

(5) A “block wall” is defined as a wall constructed of slump block, split-face block, any other block, brick, or concrete and/or as defined in Section 22.22.700(14)(i) of this code.

(6) A “decorative fence” is defined as a fence constructed of wood or wrought iron and/or as defined in Section 22.22.700(14)(ii) of this code. (Ord. 882 § 1, 2004)

22.70.020 Adoption.

With the advice of the director of public works, the director of community development, the city manager, and the planning commission, the city council shall adopt, and revise from time to time, a set of development standards for the design, construction and maintenance of improvements on both public and private property, which may include but not be limited to the following:

(1) Highways, streets, alleys, walkways, bicycle paths, equestrian trails, and other rights-of-way;

(2) Driveways, parking areas and parking spaces;

(3) Utilities and drainage;

(4) Street furniture, trees and landscape treatment;

(5) Public facilities;

(6) Landscaping;

(7) Architectural design;

(8) Walls and fences;

(9) Refuse collection areas and facilities;

22.70.400 Architectural design.

(1) Exterior Colors of Residential Structures.

(a) The following shall apply toward the exterior colors of all residential structures:

(i) For natural, decorative masonry building materials on residential structures, the color shall be limited to the natural, unpainted color of said material;

(ii) For all other surfaces on residential structures, such as wood and stucco, the colors shall be limited to the colors exhibited in the color palette;

(iii) Paint or stain colors shall be applied on residential structures according to the provisions of the color palette;

(b) Homeowners, residents and/or tenants, including all who possess membership in a homeowners’ association, shall be limited to selecting colors from the color palette. Any person desiring to apply paint or stain on a residential structure shall obtain prior approval in writing via a paint color permit from the department of community development; and

(c) All amendments to the color palette shall be pursuant to a resolution of the planning commission. (Ord. 918 § 5, 2006)

22.70.450 Walls and fences.

(1) Stucco, Paint, and Stain Colors.

(a) Painting or staining of all block walls shall be prohibited unless the paint color is deemed by the director of community development to be consistent with the natural color of the building material used to construct the subject block wall. Any person desiring to paint or stain a block wall shall obtain prior approval in writing from the department of community development;

(b) Stucco may not be applied onto block walls located along the perimeter of a residential subdivision unless it is deemed to be an aesthetic enhancement by the director of community development. Any person desiring to apply stucco onto a block wall located along the perimeter of a residential subdivision shall obtain prior approval in writing from the department of community development;

(c) Stucco may be applied onto block walls located within a residential subdivision; provided, that the color of the stucco is in accordance with the color palette and when its application is deemed to be an aesthetic enhancement by the director of community development. Any person desiring to apply stucco onto a block wall located within a residential subdivision shall obtain prior approval in writing from the department of community development; and

(d) Painting or staining a decorative fence may be permitted; provided, that the color is deemed by the director of community development to be compatible with the residence on the same residential lot. Any person desiring to paint or stain a decorative fence shall obtain prior approval in writing from the department of community development;

(2) Building Permit Requirement.

(a) Any construction of a new or replacement block wall greater than the height of thirty inches shall require prior approval in writing as well as a building permit from the department of community development. (Ord. 918 § 6, 2006)
