5.20.010 Public dance or public event defined.

A “public dance” or a “public event,” within the meaning of this chapter, means any function in which the public is admitted and which is held or conducted for a profit, whether through the sale of tickets or admission fees at the door of the hall where such dance or public event is held or conducted in any manner whatsoever. 5.20.020 Permit required—Term.

It is unlawful for any person(s), society, organization, firm, corporation or other agency to hold or conduct any public dance or public event within the limits of the city without first obtaining a permit from the chief of police of the city. The permit shall be valid for a period of thirty days from and after the date of its issue. (Ord. 269 N.S. § 2, 1969)

5.20.030 Inspection of premises—Appeal from denial of permit.

It shall be in the discretion of the chief of police, upon the application of any persons mentioned in this chapter for a permit, to inspect the premises where such dance or public event is proposed to be held or conducted, and if in his judgment such place is not a fit and proper place in which a public dance or public event should be held or given, he may deny such permit; provided, however, that he shall notify the applicant in writing of such denial, and the applicant may, within ten days thereafter, appeal to the city council in writing, and the city council may determine whether or not such permit shall be granted. 5.20.040 Supervisory officers required.

All such dances or public events shall be under the supervision of the chief of police or such officers as shall be appointed by him, and in such numbers as shall be determined by the chief of police. Such officers shall be in attendance from the opening of the dance or public event to the closing thereof, and shall have free access to and supervision of such dance or public event and of all rooms used by the patrons connected with such dance or public event. 5.20.050 Reimbursement for supervisory officers.

As a condition to the granting of such permit for a dance or public event, the applicant shall agree to reimburse the city for the wages and salary of the officers or reserve officers who shall be responsible for the supervision of the dance. The amounts to be paid to the city shall be determined by resolution of the city council. (Ord. 269 N.S. § 5, 1969)

5.20.060 Violation—Penalty.

Any person in violation of the provisions of this chapter shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not to exceed five hundred dollars, or by imprisonment in the county jail for a period not to exceed six months, or by both such fine and imprisonment.
