12.20.010 Regulations for park use.
The following regulations shall govern the use of parks and park facilities in the city and shall have the force of law. (Ord. 362-80A § 1 (part), 1980)
12.20.020 Hours open to the public.
City parks are open from seven a.m. to ten p.m., local time. No person shall remain in, or enter into any city park after ten p.m. and before seven a.m. unless authorized to do so by the city manager or chief of police for nonrecreational purposes or except in cases of emergency involving danger to life, limb or property. This section does not prohibit entry into parks of persons in the employ of the city while on official duty in connection with the supervision and maintenance of parks. 12.20.030 Horses prohibited.
No horses are permitted in city parks. Horseback riding in city parks is prohibited. (Ord. 362-80A § 1(b), 1980)
12.20.040 Motorcycles and motorbikes prohibited.
Motorcycles and motorbikes are prohibited in the parks. (Ord. 362-80A § 1(c), 1980)
12.20.050 Bicycle riding prohibited.
Bicycle riding is prohibited in the parks. Bicycles may be walked through parks or parked in spaces provided for them. (Ord. 362-80A § 1(d), 1980)
12.20.060 Motor vehicles restricted—Permit required when.
Motor vehicles are prohibited in the parks, except those utilized by permission of the city manager or chief of police in connection with maintenance and supervision of parks. The city manager may grant permits for temporary entry and parking of motor vehicles used in connection with special events for such purposes as demonstration or the delivery of goods and supplies. 12.20.070 Overnight camping prohibited.
Camping is prohibited in city parks, except in places designated for day time camping or picnicking. Overnight camping is prohibited in any event. (Ord. 362-80A § 1(f), 1980)
12.20.080 Baseball field—City resident priority.
A. The baseball field at the main city park is primarily for the use of ball teams located in Cloverdale, sponsored by Cloverdale citizens or otherwise substantially organized and operating to provide recreation for the immediate or continuing benefit of Cloverdale citizens.
B. It is the policy of the city to give priority use of the baseball field to teams which meet the standard of having eighty percent or more of their members as residents of the city and its immediately surrounding areas, and which play one half or more of their scheduled games in Cloverdale, or which are sponsored by a resident citizen or organization.
C. The council reserves the right to charge reasonable fees for the use of the ball field by organized teams and differentiate the rate of fee between teams which meet the above standard and those which do not. Such fees shall be fixed by resolution of the city council and shall be allocated as the city council may determine to specific costs of operating the ball field or to general recreation purposes. 12.20.090 Baseball field—Reservation and permit requirements.
A. Any person, group of persons or organization which desires a reservation for special events in parks or on the baseball field may apply to the city manager for a permit.
B. Permission for special events may be granted if it appears the event will not interfere with the general use and enjoyment of the park or facility by the public and that the event will be conducted in a safe and orderly manner, subject to the regulations of this chapter.
C. Permit fees shall acknowledge receipt of a copy of this chapter, and shall acknowledge responsibility in writing for the risk of any loss or injury resulting from the activity sponsored under the permit.
D. In case of any large gathering of people, or activity which may involve risk of personal injury or property damage the permittee may be required to obtain liability insurance to cover the event, with the city as an additional insured for the event.
E. A permit may be refused for any event or activity which poses risk of damage to any park or park facility unless the permittee posts with the city a bond or other security in an amount reasonably calculated to indemnify against any loss. (Ord. 385-83 § 12 (part), 1983; Ord. 362-80A § 1(h), 1980)
12.20.100 Events requiring police permit.
The police department shall be consulted before any permit is issued for a special event involving a large gathering of people or an activity which may involve risk of personal injury or property damage and if the chief of police has reasonable cause to believe that police protection or security measures beyond the normally available resources of the police department should be assigned to the event, the permit may require the event sponsor to provide special police or other security measures, and may provide for reimbursement to the city of the cost to the city for providing special police protection. 12.20.110 Violation—Penalty.
Any person who violates any regulation contained in this chapter is guilty of a misdemeanor, and for each separate offense is liable to a fine of not exceeding five hundred dollars or imprisonment in the county jail not exceeding six months, or both. (Ord. 362-80A § 2, 1980)
