CIRCUSES AND STREET CARNIVALS

5.4.01 Definitions.
For the purposes of this chapter, certain words and phrases used herein are defined as follows:
(a) “Circus” shall mean an exhibition or entertainment at which feats of horsemanship, acrobatic feats, or trained or wild animals are exhibited or displayed.
(b) “Street carnival” shall mean and include a group of two (2) or more shows, entertainments, games, devices, amusements, vaudeville, dramatic, or minstrel performances, or games, tricks, devices, or wheels, the result of the operation of which is dependent upon chance or skill and as a result of the operation of which things or representatives of value are given or paid, which such shows or games are conducted in tents or temporary structures upon public streets, parks, or vacant lots; provided, however, “street carnival” shall not include circus. 5.4.02 Permit required.
No person shall conduct, carry on, or manage a circus, street carnival, or any similar exhibition within the City unless such person has procured a permit therefor from the City Clerk. (§ 1, Ord. 344)
5.4.03 Permit application: Fee.
Any person desiring such permit shall make an application in duplicate on the form provided therefor and shall file the same with the City Clerk and pay therewith an application fee in the amount of twenty-five and no/100ths dollars ($25.00), which fee shall not be refundable unless the applicant is an organization which is exempted from the payment of business license fees within the City. Such an organization shall make such application but shall not be required to pay the application fee. (§ 2, Ord. 344)
5.4.04 Permit application: Council hearing: Notice.
The City Clerk shall set the matter of the application on the agenda of the Council for a hearing on a date not later than twenty (20) days after the date of such filing and shall give notice of the hearing on the application to the applicant not less than five (5) days prior to the date set for the hearing. 5.4.05 Permit application: Investigation.
One copy of the application shall be submitted to the Chief of Police who shall make an investigation of the applicant and a report and recommendation on the granting of the permit in writing to the Council on or before the date set for the hearing on such application. (§ 2, Ord. 344)
5.4.06 Permit application: Council hearing: Decision.
The Council at such hearing shall decide and determine whether, and upon what conditions, a permit shall be issued. (§ 2, Ord. 344)
