5.14.01 Parade defined.

For the purposes of this chapter, “parade” shall mean any march or procession consisting of persons, animals, or vehicles, or a combination thereof, except funeral processions, upon any public street, sidewalk, alley, or other public place, which march or procession does not comply with normal and usual traffic regulation or controls. 5.14.02 Permits: Required.

No person shall sponsor, conduct, manage, or participate in any parade unless and until a written permit has been issued by the Chief of Police for such parade in accordance with the provisions of this chapter. As used in this section, “person” shall include a corporation or association. All applications for permits shall be filed with the Chief of Police at least thirty (30) days prior to the proposed date of the parade. (§ 1, Ord. 79-51, eff. November 8, 1979)

5.14.03 Permits: Issuance: Form.

(a)    No permit shall be issued authorizing the conduct of a parade which the Chief of Police finds is proposed to be held for the sole purpose of advertising any product, goods, wares, merchandise, or event and is designed to be held purely for private profit.

(b)    The Chief of Police shall issue such permit if he finds that: (1) The conduct of such parade will not substantially interrupt the safe and orderly movement of other traffic contiguous to its route;

(2)    The conduct of such parade will not require the diversion of so great a number of police officers of the City to properly police the line of movement, and the areas contiguous thereto, as to prevent normal police protection to the City;

(3)    The conduct of such parade will not interfere with the movement of fire-fighting equipment en route to a fire;

(4)    The conduct of such parade is not reasonably likely to cause injuries to persons or property or to provoke disorderly conduct or create a disturbance;

(5)    The concentration of persons, animals, and vehicles at assembly points of the parade will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such assembly areas;

(6)    Such parade shall move from its point of origin to its point of termination expeditiously and without stopping en route; and

(7)    The applicant has executed and filed with the Chief of Police a written guarantee to save the City harmless from all liability and/or damages as a result of granting the permit.

(c)    The permit shall contain the following information:

(1)    The date of the parade;

(2)    The organization making the application for the permit;

(3)    The event;

(4)    The route; and

(5)    The starting time. (§ 1, Ord. 79-51, eff. November 8, 1979)

5.14.04 Permits: Revocation: Notices: Appeals.

The Chief of Police shall act upon the application for a parade permit within fifteen (15) days after the filing thereof. If the Chief of Police disapproves the application, he shall mail to the applicant, within fifteen (15) days after the date upon which the application was filed, a notice of his action stating the reasons for his denial of the permit. Any person aggrieved shall have the right to appeal the denial of a parade permit to the Council by filing a written notice thereof with the City Clerk within five (5) days after the notice of such action. The decision of the Council after a hearing on such appeal shall be final. (§ 1, Ord. 79-51, eff. November 8, 1979)

5.14.05 Violations: Penalties.

It shall be unlawful for any person to violate any provision or to fail to comply with any requirement of this chapter. Any person violating any such provision or failing to comply with any of the requirements of this chapter shall be guilty of a misdemeanor and subject to punishment as provided in Section 1-2.01 of Chapter 2 of Title 1 of this Code.
