FOOD ESTABLISHMENTS

6.2.01 Permit required.
No person shall engage in the business of storing, handling, processing, manufacturing, vending, transporting, selling, or offering for sale any substance used, or intended to be used, for human consumption without first having obtained from the Health Officer an operating permit. (§ 1, Ord. 196)
6.2.02 Permit application: Inspection of premises: Issuance and denial.
When an application has been made for an operating permit, it shall be the duty of the Health Officer to make, or cause to be made, an inspection of the premises or place where it is desired to establish the business of processing, storing, handling, or selling substances designed or intended to be used for human consumption. If, on inspection, such premises or place shall be found to comply with the laws of the State and the rules and regulations of the Health Officer, an operating permit shall be issued to the applicant. Such operating permit shall be in such form and wording as shall be determined by the Health Officer. If the issuing of an operating permit is refused by the Health Officer, he shall state the reason therefor briefly in writing. (§ 2, Ord. 196)
6.2.03 Permit: Posting.
Such operating permit shall be posted in a conspicuous place in a suitable frame on the premises where such substances are manufactured, stored, vended, handled, processed, transported, sold, or offered for sale. (§ 1, Ord. 196)
6.2.04 Permit: Revocation.
Such operating permit shall be revocable for cause by the Health Officer who shall state briefly his reasons therefor in writing. (§ 1, Ord. 196)
6.2.05 List of employees.
It shall be the duty of any operator of a food establishment to keep an accurate up-to-date list of all employees therein and to furnish a true copy of such list to the Health Officer upon request. (§ 2, Ord. 196)
6.2.06 Food handlers’ cards: Required.
It shall be unlawful for any person to engage in the handling, serving, preparation, or storage of food or drink in any bakery, butcher shop, restaurant, hotel, fountain, tavern, or other eating or drinking place in the City, or in the sanitizing of utensils in any of such establishments, for a period of time longer than thirty (30) working days, or for any food establishment operator to employ or permit any person to engage in such activities therein for longer than thirty (30) working days, unless such person holds a food handler’s card issued by the Health Officer. 6.2.07 Food handlers’ cards: Term.
All food handlers’ cards shall expire one year from the date of issuance. (§ 3, Ord. 196)
6.2.08 Food handlers’ cards: Fee.
A fee in the amount of One and no/100ths ($1.00) Dollar shall be charged for each food handler’s card issued. (§ 3, Ord. 196)
6.2.09 Food handlers: Course of instruction: Examinations.
No person shall be issued a food handler’s card until he or she has completed satisfactorily a course of instruction which shall be provided free by the County Health Department. As a prerequisite to the issuance of a food handler’s card, the Health Officer may impose any requirement, physical or other tests or examinations, which may be necessary for the protection of the public health. The Health Officer shall not give any treatment required for any condition revealed by such examination or test, and the County Health Department shall not be responsible in any manner for the cost of such treatments.
