GRADE DIFFERENTIALS, CLEAN UP OF PUBLIC AND PRIVATE PROPERTY, DUST CONTROL

8.13.02 Clean up of public and private property.
8.13.01 Grade differential.
Any vertical cut or fill differential between adjacent properties shall be supported by an approved retaining wall. The grade differential between adjacent properties may be relieved in accordance with Public Works Standard ST19.P. if approved in writing by the owner of such low property and the Building Official in the form of an easement or covenant running with the land as approved by the City Attorney. No surface drainage shall be permitted to drain across adjacent properties unless disposal occurs through an approved drainage facility located in a recorded easement. (§ 4, Ord. 08-22, eff. 8.13.02 Clean up of public and private property.
No person, insofar as practical or possible, shall permit any earth, trash, mud, or other debris from any construction or grading site to be deposited on public streets, sidewalks, or properties, including haul roads to and from such site, nor shall such debris be deposited on private properties unless approved by the Building Official.
On notification by the Building Official, the owner of such construction or grading site shall immediately clean up such earth, trash, mud, or other debris. The notification shall specify a time limit for the clean up. If the clean up is not completed within such specified time, the Building Official may issue a stop notice for all work at the site until the clean up is accomplished or have the clean up completed and the expenses charged to the contractor and/or owner of the property where the construction or grading is occurring or administrative citations may be issued five (5) days after written notification of construction clean up violations. 8.13.03 Dust control.
Dust shall be controlled at any construction or grading site and any routes used for the transport of materials to or from such site. Dust control measures shall be carried out at all times, using such methods as may be approved by the Building Official. Failure to carry out continuous dust control shall be cause for the Building Official to issue a stop notice on all work until such dust control measures are implemented and continuously applied or administrative citations may be issued twenty-four (24) hours after written notification of construction dust control violations.
