REMOVAL OF COMMISSIONERS AND COMMITTEE MEMBERS FOR ABSENCES

2.21.010 Applicability.

Except as to the community and environment commission, this chapter is applicable to all boards, commissions and committees established or formed by formal action of the city council and the persons appointed by the council to serve as members of those boards, commissions and committees (for purposes of this chapter, collectively referred to as “commission”). 2.21.020 Removal for absences.

In the event that a commission member fails to attend three regular commission meetings in a twelve-month period, then, commencing on the day after she/he misses the third regular meeting, that member shall not thereafter participate in or vote on any matter brought before the commission (except as a member of the public) unless and until the council, by a majority vote of the entire council, finds that member to have missed his/her third (and/or more) regular commission meeting for good cause and allows that member to remain on the commission. The city manager shall be responsible for monitoring the attendance of all commission members. When a commission member fails to attend the third regular commission meeting under the circumstances described in the first sentence of this section, she/he shall be notified of such by the city manager and within thirty days of the date of said notice, said member shall be required to schedule, by contacting the city manager to do so, an appearance before the city council at a regularly scheduled city council meeting at or before which time said member shall be required to show cause why she/he missed such third regular meeting. Said appearance before the city council must be set within said thirty-day period, unless the city manager consents to the appearance being set for a later date. The city manager shall confirm the date of the council meeting in a writing mailed to the last known address of the subject member. If said member fails to timely schedule an appearance with the city council, or if said member and his/her representative, if any, fail to personally appear at the council meeting after scheduling same, or, notwithstanding the foregoing, if prior to the scheduled council meeting said member fails to deliver to the city manager a writing showing good cause for having missed said three meetings, or if the city council does not, by a majority vote of the entire council, find there to be good cause for the member having missed the said third or more meeting, then the member may be removed by the mayor, subject to the approval of the council by a vote of the majority of the entire council, or by a majority vote of the entire city council. The city council shall be the sole judge as to whether or not good cause is shown. If the member is removed, the new appointment shall be made at the sole discretion of the councilmember who made the original appointment, and the member shall serve at the discretion of that councilmember. 2.21.030 Compensation.

Members of the commissions shall receive no compensation except such expenses as are authorized by law. (Ord. 806 § 4(part), 2007).
