2.30.010 Title.

This chapter shall be known as the “economic development commission ordinance of the city of Dinuba.” (Ord. 2013-02 § 1 (part), 2013)

2.30.020 Intent and purpose.

A.    The purpose of this chapter is to continue to preserve, promote and improve the economic health and resources of the city of Dinuba for educational, cultural, economic and general welfare of the public by the creation of the economic development commission in the city of Dinuba, to serve in an advisory role to the city manager and city council.

B.    The council finds that the city of Dinuba has historically taken a leadership role in economic development in Northern Tulare County by the creation of the Surabian Industrial Park for economic development. The council finds that the city continues to strive to attract businesses that create jobs and form a viable tax base for the city and the region.

C.    The council finds that this chapter benefits all of the residents of Dinuba and all owners of property and declares as a matter of public policy that the continued effort to create a business friendly environment to attract businesses to create jobs and continue growth is a matter of public policy that this chapter is required in the interest of the health, prosperity, safety, welfare and economic well-being of the people. The continued effort to attract businesses and services to foster economic development is hereby designated to be a public purpose. (Ord. 2013-02 § 1 (part), 2013)

2.30.030 Establishment.

A.    An economic development commission is established by the city and will act in an advisory capacity to the city council and the city manager. The commission shall be known as the Dinuba economic development commission (DEDC).

B.    DEDC shall serve as an advisory commission of the city council in matters pertaining to the economic development and redevelopment of the city of Dinuba community. In this role, the DEDC may function in the following capacities: assist the city council and city staff in business attraction, recruitment and retention efforts in accordance with the city council’s direction; act as a community liaison on behalf of the city council on matters pertaining to economic development; provide input to the city council and city staff on economic development issues, concerns and initiatives.

C.    DEDC shall, as directed by the city council, be assigned as a liaison between the city council and other economic development organizations in Tulare County and the region; and be assigned as a liaison with the Dinuba Chamber of Commerce; and generally promote, assist and foster the city council’s efforts to generate sales tax dollars in the community, create living wage jobs in the community, maintain the economic health of businesses in the community, and inform and educate the community as to the value of economic development for Dinuba. 2.30.040 Membership.

The members shall be registered voters and the commission shall consist of five members nominated and appointed by the city council. Members shall have their primary economic interest in the Dinuba business community and should represent, but not be limited to, the following areas: banking, real estate, commercial businesses, industrial businesses, job developers, not-for-profit organizations, educators, transportation and energy providers and agriculture. 2.30.050 Terms.

Of the members of the commission first appointed, three shall be appointed for a period of one year, three shall be appointed for a period of two years and three shall be appointed for a period of three years, said terms to be established by a random selection process. Their successors shall be appointed for terms of three years. All terms shall run concurrent with the calendar year. (Ord. 2013-02 § 1 (part), 2013)

2.30.060 Operating policies.

Except as otherwise provided in this chapter, the commission shall conform to the policies as established by resolution of the city council and as subsequently amended by majority vote of the city council. (Ord. 2013-02 § 1 (part), 2013)

2.30.070 By-laws.

As needed and with the assistance of the members of city staff, the commission may, by resolution, adopt by-laws by which it shall conduct the order of its business. Said by-laws shall be subject to the approval of the city council by majority vote. (Ord. 2013-02 § 1 (part), 2013)

2.30.080 Officers and elections.

The commission shall elect a chairperson and vice-chairperson whose terms shall be for one year and the election shall be conducted at the first meeting in January of each year. (Ord. 2013-02 § 1 (part), 2013)

2.30.090 Meetings.

The commission shall meet quarterly at seven a.m. on the first Thursday of each quarter month (four meetings annually), but only as required for business. Meetings shall be held at Dinuba City Hall, or a regular meeting place on city premises or as determined by the commission chair. (Ord. 2018-03 (part), 2018: Ord. 2013-02 § 1 (part), 2013)

2.30.100 Brown Act.

The commission shall be governed by the provisions of the Brown Act (Government Code Section 54950 et seq.). (Ord. 2013-02 § 1 (part), 2013)

2.30.110 Commission duties.

A.    DEDC shall advise public officials and the general public of the ongoing efforts by the city and commission regarding sustained economic development in the city. It may recommend general policies concerning economic development. It may evaluate suggestions, criticisms and comments in light of such policies. It may recommend a long range program for the improvement, acquisition and development of a sustained local economy, to create jobs and business opportunities in the city and the region.

B.    DEDC shall cooperate with any other public authorities to aid and assist in the coordinating of economic development in the city.

C.    DEDC shall perform such additional duties as may be designated by the city council by ordinance or resolution. (Ord. 2013-02 § 1 (part), 2013)

2.30.120 Involuntary termination of appointment.*

The city council may terminate any appointment at any time upon its own motion. In addition, the city council will consider the termination of an appointment to the commission should the commissioner so appointed meet one or more of the following criteria:

A.    A commissioner who absents himself/herself for any reason from the commission meeting shall request to have such absence appear on the agenda of the following month’s regular commission meeting for the commission to consider whether the absence was an excused absence. Failure of a commissioner to make such a request shall result in the absence as being recorded as unexcused. A commissioner’s attendance record shall be forwarded to the council for action in either of the following circumstances:

1.    If the commissioner fails to attend three consecutive regular meetings of the commission without any of that commissioner’s three absences having been excused by the commission; and/or

2.    If the commissioner fails to attend eighty-five percent of the scheduled meetings of the commission during any period of twelve consecutive months. For the purpose of calculating this percentage, meetings for which the commissioner’s absence was excused by the commission shall not be counted as a failure to attend;

B.    If the commissioner is convicted of a crime of moral turpitude. (Ord. 2013-02 § 1 (part), 2013)

2.30.270 Severability.

If any section, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portion of this chapter. The council hereby declares that it would have passed this ordinance and adopted this chapter and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
