13.76.005 Statutory authorization.
The legislature of the state of California has in Government Code Sections 65302, 65560 and 65800 conferred upon local government units authority to adopt regulations designed to promote the public health, safety, and general welfare of its citizenry. Therefore, the city council of the city of Dinuba does hereby adopt the following floodplain management regulations. (Ord. 2022-10 § 2, 2022; Ord. 2003-12 § I (part), 2003)
13.76.006 Findings of fact.
A. The flood hazard areas of the city of Dinuba are subject to periodic inundation which results in loss of life and property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for flood protection and relief and impairment of the tax base, all of which adversely affect the public health, safety, and general welfare.
B. These flood losses are caused by uses that are inadequately elevated, floodproofed, or protected from flood damage. The cumulative effect of obstructions in areas of special flood hazards, which increase flood heights and velocities, also contribute to the flood loss. 13.76.010 Purpose.
It is the purpose of this division to promote the public health, safety and general welfare, and to minimize public and private losses due to flood conditions in specific areas by provisions designated:
A. To protect human life and health;
B. To minimize expenditure of public money for costly flood control projects;
C. To minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of the general public;
D. To minimize prolonged business interruptions;
E. To minimize damage to public facilities and utilities such as water and gas mains; electric, telephone and sewer lines; and streets and bridges located in areas of special flood hazard;
F. To help maintain a stable tax base by providing for the sound use and development of areas of special flood hazard so as to minimize future blighted areas caused by flood damage;
G. To ensure that potential buyers are aware that property is in an area of flood hazard; and
H. To ensure that those who occupy the areas of flood hazard assume responsibility for their actions. (Ord. 2022-10 § 2, 2022; Ord. 98-8 § 2, 1998; Ord. 649 § 1 (part), 1982)
13.76.020 Methods of reducing flood losses.
In order to accomplish its purpose, this division includes methods and provisions for:
A. Restricting or prohibiting uses which are dangerous to health, safety and property due to water or erosion hazards, or which result in damaging increases in erosion or flood heights or velocities;
B. Requiring that uses vulnerable to floods, including facilities which service such uses, be protected against flood damage at the time of initial construction;
C. Controlling the alteration of natural floodplains, stream channels, and natural protective barriers, which help accommodate or channel floodwaters;
D. Controlling, filling, grading and other development which may increase flood damage; and
E. Preventing or regulating the constructing of flood barriers which will unnaturally divert floodwaters or which may increase flood hazards in other areas. (Ord. 2022-10 § 2, 2022; Ord. 988 § 3, 1998; Ord. 649 § 1 (part), 1982)
13.76.030 Applicability.
These regulations, in conjunction with the building codes, provide minimum requirements for development located in flood hazard areas, including the subdivision of land; filling, grading and other site improvements; installation of utilities; installation, placement and replacement of manufactured homes; placement of recreational vehicles; installation of tanks; temporary structures and temporary or permanent storage; utility and miscellaneous Group U buildings and structures; certain building work exempt from permit under the building codes; and flood control projects.
