AGREEMENTS FOR PURCHASE OF REAL PROPERTY

5.04.030    City Council approval of property appraisal.

5.04.010 Purchase of real property for twenty-five thousand dollars ($25,000.00) or less.

Subject to availability of funds, and subject to the procedures, if applicable, specified in this title, the Purchasing Officer shall have the authority to execute any agreement for the purchase of real property, or any interest therein, and enter into any agreement regarding such purchases of real property, where the amount of the expenditure (exclusive of escrow costs, recording fees, title insurance premiums and similar expenditures) is twenty-five thousand dollars ($25,000.00) or less. Any such agreement executed by the Purchasing Officer, which has been approved as to form by the City Attorney, shall be binding upon the City without further action by the City Council. The signature by the Purchasing Officer shall constitute certification that there remain unexpended and unapplied balances of the appropriations or funds applicable thereto sufficient to pay the estimated expense of executing the agreement. 5.04.020 Purchase of real property for twenty-five thousand dollars ($25,000.00) or more.

All agreements for purchase of real property involving expenditures of more than twenty-five thousand dollars ($25,000.00) shall be approved by the City Council, for signature by the Purchasing Officer, but the City Council may by resolution authorize the Purchasing Officer to purchase real property at a not-to-exceed maximum price specified in said resolution and in such instances the Purchasing Officer shall have the authority to purchase the real property where the amount of the expenditure (exclusive of escrow costs, recording fees, title insurance premiums and similar expenditures) does not exceed the amount specified in the resolution. Any such agreement, which has been approved as to form by the City Attorney, executed by the City Officer shall be binding on the City without further action by the City Council. [Ord. 13-010 § 1.]

5.04.030 City Council approval of property appraisal.

When required by Cal. Gov’t. Code § 7260 et seq., the City shall have an appraisal prepared for any real property which it is considering acquiring. Prior to the Purchasing Officer commencing negotiations for said property, the City Council shall (A) review and approve the appraised value of said property, and (B) provide specific authority for the Purchasing Officer to conduct negotiations and execute appropriate documents necessary to conclude purchase.
