2.40.010 Policy established.

The city council establishes the policies, rules and regulations set forth in this chapter governing holidays, vacations and sick leaves for city employees. This chapter may be changed from time to time by resolution. (Ord. 416 § 1, 1995; Ord. 54, 1960)

2.40.020 Employee defined.

“Employee” means and includes full-time officers of the city. (Ord. 54 § 5, 1960)

2.40.030 Retroactive provision for accrued sick leave and vacation benefits.

For the purpose of computing accrued sick leave with pay and vacation benefits accrued and for no other purpose, this chapter shall be retroactive to July 1, 1957. (Ord. 54 § 4, 1960)

2.40.040 Vacations.

A. A vacation period of 10 days per year shall be allowed each full-time employee who has worked for the city one year, and a vacation of 15 days per year shall be allowed each full-time employee who has worked for the city five consecutive years. Such vacation time accrued may be carried over for two years. If a legal holiday occurs during the vacation period the employee will, at the discretion of the city, either be paid at the employee's regular rate of pay for said holiday or receive equivalent vacation time off.

B. Each full-time employee shall accrue vacation benefits at the rate of five-sixths of a day per month worked, except for those employed regularly and continuously for five years or more who shall accrue vacation benefits at the rate of one and one-quarter days per month worked.

C. A full-time employee about to resign, or who is to be laid off or dismissed and who has earned a vacation, may be granted a vacation for the time so earned, which vacation must be taken prior to the effective date of any such resignation, retirement or layoff; or in lieu of such vacation and at the discretion of the city, the employee may be granted a lump sum payment for vacation time accrued to his credit.

D. When separation is caused by the death of any employee, payment shall be made to the estate of such employee, or in applicable cases, as provided by Section 630 of the Probate Code. (Ord. 447 § 1, 2000; Ord. 54 § 1, 1960)

2.40.050 Sick leave with pay.

A. Full-time city employees shall be entitled to one day sick leave with pay for each calendar month worked, which sick leave shall be cumulative for an unlimited amount. Employees absent because of illness shall cause the city administrator to be notified as soon as possible and shall submit a doctor's certificate of such illness for any illness in excess of three consecutive days. If good cause appears therefor, the city administrator may require a doctor's certificate for illnesses of less than three days.

B. No city employee shall be entitled to sick leave while absent from duty on account of the following causes:

1. Disability arising from any sickness or injury purposely self-inflicted or caused by any of his wilful misconduct;

2. Sickness or disability sustained while on leave of absence.

C. No employee shall be entitled to sick leave while on vacation.

D. Full-time employees who are disabled by injury compensable under the workman's compensation laws of the state shall be entitled to full pay during the period of such disability so long as they have accumulated sick leave and for the period of such sick leave and the sick leave account shall be charged accordingly; provided, however, that during such period of disability with full pay such employee turn over to the city temporary disability indemnity payments received under the workmen's compensation laws of the state, and the city shall recredit the sick leave account to the amount of such reimbursement. 2.40.060 Holidays.

A. Regular Holidays. The following holidays are recognized as municipal holidays. All regular and probationary employees shall have these days off except as otherwise provided in subsection B of this section.

1. New Year's Day;

2. Martin Luther King Jr. Day;

3. President's Day;

4. Memorial Day;

5. July 4th;

6. Labor Day;

7. Veteran's Day;

8. Thanksgiving Day;

9. Day after Thanksgiving;

10. Christmas Eve;

11. Christmas Day;

12. Two floating holidays to be accrued January 1st of each year.

When a holiday falls on Saturday, the preceding Friday shall be deemed to be the holiday in lieu of the day named. When a holiday falls on a Sunday, the following Monday shall be deemed to be the holiday in lieu of the day named.

B. Police and Dispatcher Personnel. Holidays shall not be granted to regular and probationary police and dispatcher personnel. However, these employees shall accrue 10 additional paid days of vacation accrual each calendar year, in lieu of paid holidays, at the employee's current rate of pay. Two additional days will be accrued as floating holidays.

C. Compensation for Work on Paid Holidays. Regular and probationary employees, except police and dispatcher personnel, assigned to work on holidays shall receive compensating time off or overtime payment in accordance with the overtime policy.
