RESIDENTIAL GARAGE SALES

5.24.010 Purpose.
It is the purpose and intent of the city council to regulate sales of merchandise from residential zoned premises within the city in the interests of the public health, safety and general welfare of its citizens. Regulation is found to be necessary to prevent such sales practices from becoming public and private nuisances. (Ord. 167 § 1, 1977)
5.24.020 Permitted use.
Sales of personal property to the general public by means of a garage sale, patio sale, yard sale or other sales similarly conducted shall be a permitted use; provided, such sales are held and conducted in accordance with the provisions of this chapter. (Ord. 167 § 2, 1977)
5.24.030 Time and place of sale.
Only one such sale may be conducted in any six-month period and shall be limited to not more than three consecutive days, or to two consecutive weekends, not to exceed four days in all. The sale shall not be conducted between the hours of 8:00 p.m. of any day and 8:00 a.m. of the following day. Sales shall not encroach or be made on or from public streets or rights-of-way. 5.24.040 Signs.
One unlighted sign shall be permitted, not exceeding six square feet in area; provided, it is posted upon the garage or premises and does not encroach into or upon any public right-of-way. Such sign shall be displayed only during the period of sale. No signs shall be posted on any premises except the premises upon which sales are conducted. (Ord. 167 § 4, 1977)
5.24.050 Owned personal property.
All personal property sold at said sale shall not have been acquired or consigned to the seller for the purposes of resale. (Ord. 167 § 5, 1977)
5.24.060 Licensed retail or wholesale dealers – Prohibited.
No licensed retail or wholesale dealer shall be permitted to consign or offer for sale any goods or merchandise or participate in any private sale authorized by this chapter. (Ord. 167 § 6, 1977)
5.24.070 Right to inspect.
Any member of the police department shall have the right to inspect the merchandise on display or stored for sale on the premises during a sale authorized by this chapter. (Ord. 167 § 7, 1977)
5.24.080 Exemptions.
The provisions of this chapter shall not apply to any charitable or religious organization or educational institution for occasional sales when the proceeds from such sales are used solely for charitable, religious or educational purposes, nor shall this chapter apply to sales conducted pursuant to process or order of any court of competent jurisdiction. 5.24.090 Violation – Penalty.
It is unlawful and constitutes an infraction for any person to violate or fail to comply with any provision of this chapter. (Ord. 470, 2003; Ord. 167 § 9, 1977)
