RESIDENTIAL GARAGE SALES

5.09.050 Enforcement procedures—Notice to correct.
5.09.010 Scope.
This chapter shall regulate the conduct of any and all sales conducted on the exterior of a residential structure, or on a residential lot including, but not limited to, sales conducted in a garage or on the front, side or back yard. (Ord. 875 § 4 (part), 1997)
5.09.015 Definition.
“Garage sale” means and includes any and all sales conducted in the garage, carport or similar area on a residential structure or conducted on the exterior of a residential structure including, but not limited to, sales held on the front, side or back yard. (Ord. 875 § 4 (part), 1997)
5.09.030 Signs.
A. Signs advertising garage sales shall comply with the provisions of Chapter 17.59.
B. Enforcement procedures concerning signs advertising garage sales shall be governed by this chapter. (Ord. 875 § 4 (part), 1997)
5.09.040 Enforcement.
A. This chapter shall be enforced pursuant to the provisions of Chapters 1.08 through 1.10, inclusive.
B. The code enforcement officer shall enforce the provisions of this chapter. (Ord. 875 § 4 (part), 1997)
5.09.045 Penalties.
A. A violation of this chapter shall be an administrative violation as defined in Section 1.08.020.
B. Each of the sanctions for administrative violations identified in Section 1.09.013 shall be available for enforcement of the provisions of this chapter.
C. The fine for a first violation of this chapter shall be thirty-five dollars. Thereafter, based upon the criteria for the imposition of administrative sanctions set forth in Section 1.09.014, each violation of this chapter in the succeeding twelve-month period shall be deemed a Level A violation, as that term is described in Section 1.09.012. The range of monetary sanctions available for a subsequent violation of this chapter shall be set forth in Section 1.09.012(A)(1). (Ord. 875 § 4 (part), 1997)
5.09.050 Enforcement procedures—Notice to correct.
A. Prior to the suspension, revocation, or denial of any license or permit, or the assessment of any fee, penalty or charge, or the commencement of any other enforcement action pursuant to this chapter, the code enforcement officer shall follow the procedures set forth in Articles II and III of Chapter 1.09. The rights to judicial review set forth in Article IV of Chapter 1.09 shall apply.
B. A notice to correct shall not be required to commence the administrative hearing procedures set forth in Chapters 1.08 through 1.10, inclusive, for violations of this chapter. Pursuant to Section 1.09.024(A), a notice of administrative violation shall be served in accordance with the provisions of Section 1.09.027. (Ord. 875 § 4 (part), 1997)
