It is unlawful for any person to urinate or defecate in a public place, other than a restroom, or in a place open to public view, or upon the private property of another without the consent of the owner or person in lawful possession. (Ord. 458 § 2 (part), 1981)
9.42.020 Penalty.
A. A violation of any provision of this chapter is an infraction, punishable by a one hundred dollar fine.
B. The second violation of any provision of this chapter within a twelve-month period is an infraction, punishable by a two hundred dollar fine.
C. The third and each subsequent violation of any provision of this chapter within a twelve-month period is a misdemeanor, punishable by a three hundred dollar fine. (Ord. 1086 § 2, 2007: Ord. 847 § 5(1), 1996)
