7.04.010 Arrest and citation procedure
7.04.010 ARREST AND CITATION PROCEDURE.
In any case in which a person is arrested pursuant to Title 7, and the person arrested does not demand to be taken before a magistrate, the Animal Control Officer making the arrest shall prepare a written notice to appear and release the person on his or her promise to appear as prescribed by Cal. Penal Code Part 2, Title 3, Chapter 5C (commencing with § 853.6). The provisions of Cal. Penal Code Chapter 5C shall thereafter apply with reference to any proceeding based upon the issuance of a written notice to appear pursuant to this authority. (Ord. 891, § 2, passed 02-14-2011)
7.04.020 VIOLATION - PENALTY.
Unless otherwise specified to be a misdemeanor, violations of the provisions of Title 7 are declared to be infractions. Any violation of Title 7 may be punishable as provided in Chapter 1.12. (Ord. 891, § 2, passed 02-14-2011)
