9.08.010 SIDEWALK STANDARDS:

All sidewalks within the city shall be designed and installed in accordance with the city design standards and standard specifications. (1972 Code § 12.06.010)

9.08.020 BUILDING PERMIT PREREQUISITE:

Whenever a building permit for construction in new residential and commercial areas is granted, it shall be subject to the condition that concrete sidewalks be installed in an approved area along all street frontage of the property according to the city design standards and standard specifications. (1972 Code § 12.06.020)

9.08.030 SIDEWALK REPAIR, MAINTENANCE AND ASSESSMENT OF COSTS:

A.    Compliance With State Statute: The city adopts by this reference the provisions of California Streets and Highways Code chapter 22, part 3, division 7 (commencing with section 5600) for the purpose of maintaining and repairing sidewalks fronting any portion of a public street and assessing the costs thereof.

B.    Supplementary And Alternative Provisions: Said provisions shall be supplementary and alternative to all other authority of the city, and the public works director is authorized at his/her sole discretion to undertake sidewalk repairs in any other manner deemed necessary and proper.

C.    Liability Limited: This section shall not be construed as creating an additional cause of action of liability on behalf of any property owner, person or the city. (1972 Code § 12.06.030)

9.08.040 REPAIR OF SIDEWALKS; REPORTING DEFECTS:

A.    Owner Responsibility: Any person owning real property in the city shall repair any dangerous or defective condition lying in front of or along the side of said owner’s property adjacent to any public street.

B.    Report Dangerous Conditions: Any tenant of real property in the city shall report, in writing, to both the property’s owner and the public works director any dangerous or defective sidewalk condition which exists in front of or along the side of property occupied by said tenant fronting any portion of a public street.

C.    Recourse For Damages By Injured Persons: If, as a consequence of any sidewalks being in a condition sufficiently dangerous or defective so as to endanger persons passing thereon, any persons exercising ordinary care to avoid the danger proximately suffers damage to his/her person or property, said person shall have recourse for such damages against any property owner or tenant having either actual or constructive notice of said dangerous and/or defective condition who fails to repair or report said defect in the manner set out in this section.
