9.20.010 PERMIT REQUIRED; CONDITIONS; FEE:

A.    Permit Required; Application: Any group of twenty (20) or more persons, any organized sporting activity, or any person desiring to reserve the use of any park, recreational area, or facility shall file with the city an application in writing, and if permitted, follow established policies and procedures and special conditions attached to such permit.

B.    Conditions; Fee: If the city deems that a permit should be issued to the applicant, such permit shall set forth the policy and procedures for use of such premises, and required the payment of the fee established by the city council. (Ord. 2010-61, 2-16-2010)

9.20.020 PERMIT DENIAL:

Should the director of parks and recreation determine that any proposed use of any such premises would be detrimental to the health or safety of the city or its citizens or to the efficient operation of such premises, he shall reject the application, and in such case shall refuse to issue a permit. (1972 Code § 2.40.120)

9.20.030 REVOCATION OF PERMIT:

The director of parks and recreation shall have the power to cancel and terminate such permit and to require the immediate vacation of such premises upon his finding:

A.    That the applicant misrepresented or misstated any material fact in his application;

B.    That the use or proposed use will be detrimental to the health, safety or morals of the city or its citizens or to the efficient operation of any such premises. (1972 Code § 2.40.130)

9.20.040 APPEAL FROM DECISION OF DIRECTOR:

A.    Right Of Appeal: Any person aggrieved by, or dissatisfied with, any act performed, or ruling, determination, or order made, by the director of parks and recreation, in connection with any matter or subject under or pursuant to the authority or right granted to the director under the provisions of this chapter, shall have the right of appeal to the recreation commission for a determination of the dispute or issue involved, and the determination and decision of the commission shall be final.

B.    Filing Appeal: Any such appeal shall be in writing, shall state the act, ruling, determination or order of the director being appealed, and shall be filed with the director within fourteen (14) days of such act, ruling, determination or order of the director.

C.    Time Limit For Hearing: The commission shall hear the appeal within thirty (30) days from the date it is filed. (1972 Code § 2.40.140)
